When an individual is charged with a crime that is sexual in nature, he or she will likely not initially understand the gravity of the situation and the difficulty that lay ahead. Resultantly, a person might decide to speak with law enforcement or local social service authorities in an effort to explain his or her side of the story. What people often do not understand, however, is that when an allegation of a sexual crime is made, especially when the alleged victim is a child, the presumption that the accused is innocent until proven guilty seems to be inapplicable.

Sometimes very little effort is made by law enforcement and social service agencies to investigate whether such allegations could be false. Instead, the focus of their efforts is to obtain evidence that corroborates the allegations. The fact is that unless it was impossible for the act to have occurred, or the alleged victim recants his or her allegations, the case will move forward.

In cases involving minors, it is not uncommon for the chief or sole evidence to be presented at trial to be live testimony by the accuser along with recorded testimony of the accuser that is played in an effort to bolster the accuser's credibility. Additionally, certain out-of-court statements that would not be admissible in other types of cases are allowed specifically for these types of cases. For any person, this is a very scary situation because one's fate is dependent solely upon whose statements the judge or jury believes more.

This is exactly why such cases should be undertaken by attorneys who have the expertise and resources needed to fully investigate and challenge each and every statement that is ever made by the accuser. Every inconsistency, contradiction, implausibility, and impossibility must be uncovered and presented at trial. The accuser's life history must be explored, which often creates legal battles due to privileged and protected information laws. Prejudicial information about the accused's past must be blocked from trial. At times experts must be hired to counter the prosecution's "social science" experts. Ultimately, a defense attorney must create a plethora of reasonable doubt based upon a small amount of evidence - this requires a tremendous amount of experience, time, and commitment.

Lead attorney Tom Pavlinic began went into private practice in 1975. In the mid 1990's, he shifted his entire practice to defending individuals falsely accused of sex crimes.

He then formed Premier Defense Group which embraces the "team approach." Tom Pavlinic is the lead defense attorney in each case. Additionally, he selects an attorney from the Group who practices in the jurisdiction where charges were filed to assist him. If none of the Group's attorneys practice in that local jurisdiction, Tom will carefully choose and partner with a top-notch attorney from that local area who has a strong and respected reputation.
