We represent our clients in connection with the use of public lands, private land easements, boundaries, and litigation, and water-related issues involving land use and mined land reclamation.

We advise clients on a broad range of surface and ground water matters, including:

- Strategic planning;
-Water right analyses;
-Adjudication and administration of new water rights, changes of water rights, groundwater determinations, exchanges, and augmentation plans;
-Purchase and sale of water and water rights;
-Permitting, environmental reviews, and construction of water facilities;
-Preparation of water use agreements, carriage agreements, easements and covenants; and
-Drafting and review of proposed regulations and legislation.

Our public lands and water/land use practice includes the full spectrum of permit applications, conservation easements, rights of way, and land exchanges, as well as administrative proceedings and litigation in state and federal courts. We have considerable experience in the application of state and local land use, water quality, wetland and environmental regulations to water and other projects.

We also assist our clients with private land use transactions and disputes, including easements for road access and water facilities, conservation easements, and boundary adjustments.

The principals of Petros & White, LLC formed the firm on March 1, 1996 after practicing in large Colorado and national law firms. We have represented most of our clients for many years and obtain great satisfaction in such long-term relationships. Our clients have included municipalities, counties, special districts, ditch companies, ranchers and other individual land and water right owners, non-profit organizations, ski areas, mining companies, real estate developers and other commercial entities.

David Hayes

David Hayes joined Petros & White, LLC in 2001, and his areas of practice include water law, public lands, land use and real property law. David's clients include municipal and county governments, agricultural and ranching interests, ski areas, country clubs, private landowners, land developers and mining companies.

David assists clients in a broad range of water matters including: strategic planning, adjudications of water rights and related diligence, changes of water rights, augmentation and exchange plans, opposition to potentially injurious water rights, water rights administration issues, purchases and sales of water rights, and the permitting and construction of water facilities. He also represents clients in a diverse spectrum of land use and real property matters including: real property conveyances, conservation easements, and the negotiation, drafting, and enforcement of agreements, regulations, and legislation.

Prior to Petros & White, LLC, David worked as an Assistant Attorney General in the Natural Resources Section of the Colorado Attorney General's Office, where he represented the State and Division Engineers, Colorado Groundwater Commission, Colorado Water Conservation Board, Division of Wildlife and other State agencies in water court cases and administrative matters. He was recognized as the Colorado Division of Water Resources, Water Unit Attorney of the Year in 2000.

David obtained his J.D. in 1997 from the University of Denver College of Law, where he was a Staff Writer for the University of Denver Water Court Reporter. In 1992, he received his Bachelor of Arts degree in Political Science from the University of Colorado, where he was a member of the University of Colorado Bicycle Racing Team. David serves on the Colorado Bar Association's Water Law Section Executive Council, since 2009. He has spoken and presented papers in the areas of surface water and ground water law at numerous professional conferences.
