Davani v. Porsche Cars North America, Inc.; Defense verdict.
Testan v. Porsche AG, Porsche Cars North America, Inc., and 25 Porsche dealerships located in California. This was an attempted class action under the California Unfair Trade/Business Practices Act (Business and Professions Code Section 17200), in essence a consumer fraud case. We represented Porsche AG (the manufacturer of a Porsche 911 Targa), Porsche Cars North America, Inc. (the U.S. distributor of Porsche) and 22 California Porsche Dealerships. Lead counsel for plaintiff was Greene, Broillet, Taylor, Wheeler and Panish (John Taylor), along with plaintiff's own law firm (plaintiff is an attorney). The predominant issues were service contract v. pre-owned warranty (what was it and what did it cover?) And repair/service fraud issues against the dealers (flat rate billing (menu billing) v. actual technician time billing). Along with the assistance of the Porsche dealers' private counsel, we won dismissals of 21 of the 24 Porsche dealers in the case by the use of 21 separate summary judgment motions and prevailed at trial in August of 1999 for Porsche, PCNA and the lead dealer (Rusnak-Westlake Porsche). We prevailed on the appeal of the Plaintiff and obtained a decision by the Court of Appeal that Porsche, PCNA and the dealer were entitled to an award of attorney fees and costs incurred in defending the action through the end of the appeal. The trial court on remand awarded Porsche AG, PCNA and the dealer $510,000.00 in attorney fees and costs. The award/judgment was satisfied.
