State-Specific Rules Regarding Mold in Rental Properties

Mold in rental properties is a significant concern for tenants, with potential health consequences—such as rashes, chronic fatigue, cognitive issues, nausea, hemorrhaging, and asthma—possibly leading to lawsuits against landlords. 

Landlord responsibilities regarding mold often aren’t explicitly defined in laws. A few states and cities have started establishing mold standards, but federal law doesn’t cover this area. However, landlords can still be held responsible for mold problems even if there aren’t any specific laws governing it.  Landlords are generally responsible for maintaining habitable conditions, including fixing leaks that cause mold. Depending on the situation, state law might allow you to withhold rent if your landlord doesn’t remedy a serious mold problem, or you might be able to file a lawsuit for mold-related health problems.

Tenants also have responsibilities. Tenants should promptly report issues with mold and practice good housekeeping.
