Depositions are an important part of pretrial discovery. During a deposition, a party or a witness to a lawsuit is questioned under oath about the facts and other aspects of the case. A court reporter records all questions and answers and makes a written transcript. Depositions are used:
for trial preparation, and
during a trial, to refresh a witness's recollection or to contradict a witness's trial testimony.
