Default Judgment Definition

A judgment awarded to one party to a lawsuit or similar proceeding when the other party fails to contest the case or doesn't comply with required procedural steps.

Suppose, for instance, that the defendant (the party being sued) doesn't answer or otherwise respond to the complaint as required by the court rules, or simply doesn't show up in court. The plaintiff (the party who filed the lawsuit) can ask the court to award a default judgment against the defendant for failing to answer or defend the suit.
