State Workers' Compensation Agencies

Every state has a workers’ compensation agency, often called the Workers’ Compensation Commission or the Workers’ Compensation Division. In most states, these agencies are responsible for overseeing workers’ comp claims. Employers purchase workers’ comp insurance from private insurance companies, which then review and pay out accepted claims. When a dispute arises between the employee and insurance company, the Board hears from both sides and makes a decision about whether the employee is entitled to benefits. In a minority of states, employers are insured through the state workers’ compensation agencies rather than insurance companies. In these states, the Board also reviews and pays out accepted claims.
