An invalid arrest cannot validate a subsequent search, even if the search turns up evidence of a crime.
Is a search by the police valid after an arrest that was illegal?
If an officer lacks probable cause to make an arrest, the invalid arrest cannot validate a search. Any evidence found during a search following an improper arrest is inadmissible in evidence.
