Cosigner Agreement

Parties

This Cosigner Agreement is an agreement among  (Tenant),  (Landlord), and  (Cosigner).

Underlying Lease or Rental Agreement

Tenant has leased from Landlord the premises located at  (Premises). Landlord and Tenant signed a lease or rental agreement specifying the terms and conditions of this rental, or orally agreed to certain rental terms, on . If any provisions of the underlying lease or rental agreement conflict with this Agreement, this Agreement will control.

A copy of the lease or rental agreement is attached to this Agreement.

Cosigner's Responsibility

Cosigner agrees to be jointly and severally liable with Tenant for Tenant's obligations arising out of the lease or rental agreement described in Paragraph 2, including any extensions or renewals and any subsequent tenancies at will or at sufferance. Cosigner's liability includes but is not limited to unpaid rent, property damage, cleaning and repair costs, and any obligations that Tenant indemnify Landlord. Landlord will have no obligation to give notice to Cosigner should Tenant fail to abide by the terms of the lease or rental agreement or take any other action (or fail to act) in a way that might or will trigger Cosigner's obligations under this Agreement. Landlord need not give notice to Tenant before demanding that Cosigner fulfill its obligations. Landlord may demand that Cosigner perform as promised under this Agreement without first using Tenant's security deposit.

Assignment or Subleasing

If Tenant assigns or subleases Premises, Cosigner will remain liable under the terms of this Agreement for the performance of the assignee or sublessee, unless Landlord expressly relieves Cosigner by written termination of this Agreement.

Service of Process

Cosigner appoints any Tenant as Cosigner's agent for service of process in the event of any lawsuit or claim arising out of the underlying lease or rental agreement or this Agreement.

Keep Together

Payment of Legal Fees and Costs

If Landlord, Tenant, and Cosigner (or any combination of them) are involved in any legal proceeding arising out of this Agreement, the prevailing party will recover reasonable attorney fees, court costs, and any costs reasonably necessary to collect a judgment.
