West Virginia Adopts Pet Trust Law

West Virginia now has a law regarding pet trusts. (W. Va. Code § 44D-4-408.) Pet owners can create a trust for an pet animal such as dog or cat and have the trust terms enforced by a person the owner appoints, in case of the owner's death or incapacity. If a court decides that the trust contains more money than is needed to take care of the animals, it can direct that the excess be given to the pet owners heirs.
