Is your firm willing to coach clients who want to represent themselves?

Criminal courts in Texas rarely allow hybrid representation, so we do not coach clients who wish to represent themselves. Anyone choosing to represent themselves will be bound by the rules of evidence and procedure, and no concessions will be made because of the defendant's lack of legal training.

Pursuing an application for writ of habeas corpus, in most cases, is truly the last chance a convicted person has. It is crucial to be represented by attorneys with the necessary skill and experience to navigate this complicated area of the law.

Is your firm willing to review documents prepared by clients?

We welcome documents previously prepared by clients for review. However, we will not file any documents with the court without fully investigating the matter at hand and making necessary amendments to those documents.

What experience or education distinguishes your lawyers from others?

Prior to the bar exam, Tom worked on the Harris County Crime Lab Review Panel, assisting the lead attorney in reviewing various cases for forensic errors. His duties also included reviewing those cases for legal errors.

Since the bar exam, Tom has been practicing post-conviction and appellate law for almost ten years.He is committed to assisting those convicted of crimes in seeking justice and ensuring that they get a fair ruling from their last day in court. I have thoroughly researched Texas criminal law in those years and have been extremely successful in advocating for multiple clients.

As a native Houstonian, Tom Abbate is committed to providing the highest caliber counsel to those facing pending criminal charges, directly attacking a conviction on appeal, or seeking to overturn a criminal conviction, with the ultimate goal of reaching a fair and just result. Tom has written and submitted over one hundred criminal appeals and post-conviction writs of habeas corpus.
Mr. Abbate handles cases in all Texas counties and Federal Districts in the state of Texas.

Tom has personally authored over one hundred briefs to the various appellate courts in Texas. These briefs have covered crimes ranging from misdemeanor DWI to capital murder.
None of them has ever been less than thorough in its summation, explanation, and argumentation of the facts and the law. All of them demonstrate Tom's understanding of the law and willingness to fight for clients.

Tom has further used his knowledge to force favorable outcomes for clients at the trial court level as well. Having authored briefs and memorandums, directed to district courts, arguing points of law or asserting defenses such as self-defense, incompetency, and insanity, and
thereby forced favorable outcomes for clients such as a reduction in the charges, favorable probation terms, and outright dismissal of all charges.
