John E. Stillpass, Attorneys at Law, is a small private general practice office. Our attorneys have over seventy years' combined experience. The areas of practice include: Defense work for criminal, traffic, and OVI/DUI cases; representation of consumers under the applicable consumer protection laws including actions for violations of Ohio's Lemon Law, breach of warranty, fraud; bankruptcy, defense of foreclosure actions, and violations of the Fair Debt Collections Practices Act; representing small business owners with contracts, contract disputes, corporate filings; representation in real estate matters, and; assistance with wills, trusts, estates, and probate matters.

Criminal Defense

We believe that all individuals are entitled to an attorney diligently advocating on your behalf, should you find yourself in a situation wherein you are at risk of incarceration.

Since even low level criminal charges may potential result in the loss of other freedoms, such as driving privileges and/or the right to bear arms, it is important to have someone in your corner fighting for your freedoms.

Traffic Tickets

Traffic tickets can include, but are not limited to, OVI arrests, reckless operation charges, speeding charges, driving under suspension, etc.

Are you aware that points on your driving record can result in higher insurance rates? Can potentially result in the loss of driving privileges? We have assisted countless individuals in fighting OVI charges, in fighting point suspensions and/or in trying to avoid additional points on your driving record.

How did your firm decide on the primary area of practice(s)?

Each attorney in the office has had significant experience in the areas of law that the office practices in, and has found both personal and professional fulfillment with their specialities.

What is your firm's point of view regarding clients educating themselves on legal issues?

While it is certainly important and desirable for a client to familiarize him or herself with any legal matters in which he or she is involved, it is also our role as their advisor to assist in this process, answer all questions he or she may have, and keep the client both educated and up-to-date on their case.

Is your firm willing to review documents prepared by clients?

Since any statements, verbal or written, made by a party may be later used against that individual in a subsequent hearing; it is preferable to have documents reviewed by legal counsel. In addition, my review may assure that important issues are not overlooked.

Is your firm willing to coach clients who want to represent themselves?

I do not believe that an individual involved in a criminal matter should represent themselves and I would be reluctant to "coach" such a person. However, I have provided legal consultation to individuals representing themselves in civil matters.

Example cases

1. Deeter v. Yamaha Motor Corporation USA, 2005 WL940902 (Ohio App.2 Dist) 2005-Ohio-1931 = case involved a defective motorcycle that was out of service for 30 or more days within the owners first year and prior to 18,000 miles of use for a serious safety defect. I filed a MSJ against Yamaha that was granted, Yamaha appealed and lost. Consumer was granted a buyback and attorneys fees.

2. Yantek v. Coach Builders Limited, Hamilton County Court of Appeals 1st Dist. Case No. C080112 - client purchased a Cadillac that was converted to a convertible by the Defendant. Large amounts of water leaked into the vehicle. Consumer sued for breach of warranty. A jury entered a verdict on behalf of Mr.Yantek. Coach Builders filed an appeal and lost. Consumer awarded money for the diminution in value of the vehicle and attorneys fees.
