Paternity Cases / Father's Rights:
In Arizona, paternity proceedings are governed under A.R.S. 25-801. A paternity case usually involves young couples that have a child born out of wedlock. A paternity is like a divorce but without the division of debts and assets. In a paternity case, issues of joint or sole decision-making (ie, child custody), parenting time (ie, visitation) and child support come into play.
There has been a recent change to the law under A.R.S. 25-403.02 that calls for doing away with gender bias and allowing "both parents to share legal decision-making regarding their child and that maximizes their respective parenting time." In summary, this allows more single fathers and mothers to have joint legal decision-making rights and equal parenting time with their children. Some judges start with the presumption that both parents will share equal time with the children unless there is evidence that it would not be in the child's best interest to have either father or mother share equal parenting time.
My name is Ricardo Arvizu Bracamonte. I was born and raised in Douglas, Arizona. I am the youngest of six children. My father's name was Rico O. Bracamonte. He was also born and raised in Douglas. My mother's name was Francisca Arvizu. My mother was born in Mexico near the town of Cananea, Sonora.
I was raised primarily by my father who was both a mother and father to all of us. My mother past away when I was 18 months old. My older brother Jose would protect us from harm while my seven year old sister Francisca would nurture us with the love and care. My childhood was difficult at times but turned for the better. Without the love and support of my father I would not be here right now.
My father was my family. My father only went to the third (3rd) grade and taught us one thing, he always told us not to do as he did...but to do what he said...that was to go to school and get an education.My father left us suddenly in 1988 while I was in third year of law school at ASU. I was then 26 years old and very blessed to have known and listened to him.
Of the six children four of us went to college and two of my sisters are happily married with supportive husbands. My older brother Jose is an immigration attorney helping people from being deported in the Phoenix area. My other brother Bobby works for the Social Security Administration.
I am currently 53 years old. I divorced back in 2010 after fifteen (15) years of marriage. I have two wonderful sons who I adore and love tremendously. My oldest son currently graduated from the University of Arizona while my youngest is enrolled at Pima Community College and resides with me.
I am a true believer of present moment awareness and a follower of Eckhart Tolle. I have been reading and practicing present moment awareness for the past four years and still learning. My guiding principle is the following: "I surrender my resistance to what is...I let things be as they are and I will leave the rest to the Lord." And by that I mean that we must surrender to what is already here and not demand that things be different. Compulsive thinking is a mental illness something you don't learn or teach in law school.
Given the nature of stress and anxiety of being an attorney the best medicine for such mental illness is being capable of gaining peace of mind. By observing your mind you can accomplish that by being still inside yourself moments at a time by asking yourselfWhat is my relationship with the present moment? And with more practice the more you are able to accept life as it presents itself and take whatever options you may have at your disposal at that present moment.
By implementing present moment awareness into my practice I am able to communicate with my clients at a higher level than most attorneys. By informing clients of present moment awareness they themselves come to know that they must deal with whatever issue needs to be dealt with without being lost in their mind and come to an acceptance and surrender to what is already here with the assurance that this too will pass. By starting with being aware of the present moment, we do away with needless thinking and speculations and start focusing on what really matters to all clientsobtaining peace of mind. And we reach our destination by dealing with one thing at a time and placing our complete attention on each task until we reach our final destination.
