Firm Overview

New Jersey has some of the toughest drinking and driving laws in the United States. Prosecutors and police officers make DUI/DWI Enforcement their number one priority. When you are arrested for a DWI or a Criminal Offense you need a tough dedicated attorney who will make your defense his number one priority. Randolph Wolf has been representing people charged with these offenses for over 35 years and has handled thousands of cases. His partner, Amanda Wolf dedicates her practice to DWI defense. Let us put our experience to work for you.We appear all over the State of New Jersey including Monmouth, Ocean, Atlantic, Middlesex, Essex, Hudson and Union counties.
Example case: Client was found by police officers to be sleeping in the driver's seat of his vehicle, with the car turned off and the key in the ignition. Police woke him up and had him perform field sobriety tests which he could not successfully complete. Client was charged with 39:4-50 Driving while Intoxicated, 39:4-50.2 Refusal, 39:4-51(b) Possession of Unsealed Alcohol, 39:4-56 Delaying Traffic, 39:4-96 Reckless Driving, 39:4-97 Careless Driving and was facing up to a 2 year loss of license.
Result: The attorney argued that the Prosecutor could not prove the operation element of the DWI offense and the charge was dismissed. The attorney obtained an expert's report indicating that the proper procedures for administration of the breathalyzer test as outlined in State v. Chun were not adhered to and the analysis of the test results showed that the officer's contention that the client had not blown hard enough and given proper samples was wrong. The Court dismissed the Refusal charge. The final result was that following charges were dismissed: 39:4-50 Driving Under the Influence, 39:4-50.2 Refusal to Submit to Breathalyzer, 39:4-56 Delaying Traffic, 39-4:97 Careless Driving. Client pled guilty to 39:4-51b Open Container and was fined $256 plus court fees. Additionally he pled guilty to 39:4-96 Reckless Driving and was fined $206 plus court fees and his driving privileges in New Jersey were suspended for 30 days.

DUI and DWI

Is your firm willing to help a client with one discrete part of a case, without taking on the whole case?

No

What are your policies about dividing work within the firm to make the process most cost-effective for the client?

We generally provide fixed fees for our clients and do not bill them hourly for the work.

How frequently does your firm use mediation, arbitration, or collaborative law to resolve cases?

This is not used in DUI/DWI cases.

Does your firm provide pro bono legal services or otherwise participate in your community?

Yes we do.

What distinguishes your law firm from others?

An experienced defense attorney can make the difference between hearing a judge say "Guilty" or "Not Guilty". In cases where there is no defense, knowledgeable counsel may eliminate or reduce suspensions or jail.
During your first telephone call or in-office consultation we will listen carefully to you in order to determine the facts of your case. We will then explain to you how the laws of New Jersey apply to you. Upon hiring our firm we will write to the municipal prosecutor and obtain the complete police department file on your case. We will examine the validity of the motor vehicle stop and determine if it can be challenged.
If you are charged with Driving Under the Influence of Alcohol and there is a Breathalyzer or Alcotest Test we will obtain the technical documentation and certifications and if necessary have them reviewed by an expert who is a former New Jersey State Police Breath Test Coordinator. We will challenge where appropriate the validity of the tests and the readings.
If you are charged with driving under the influence of a drug we will obtain all of the state's proofs concerning the chain of custody of the blood or urine sample from the police department to the laboratory and the laboratory test results. We will utilize all available defenses to challenge the admissibility of the sample. If you were examined by a Drug Recognition Expert (DRE) we will obtain the report and have its results reviewed and if appropriate challenged by an Expert who is certified and as a Drug Recognition Expert Instructor.
Our Law Firm will aggressively pursue every approach to defend you against the DUI/DWI and/or Refusal. We will seek to minimize the penalties and obtain the best possible result.

What is your firm's point of view regarding clients educating themselves on legal issues?
