Real Estate

PackardDierking offers a unique combination of big law firm credentials with the personal, individually tailored service of a small law firm.

Our attorneys bring diverse experience to the practice of commercial real estate law. They have served as partners in large law firms, as community leaders, and as business professionals. Using their business savvy and legal skill, they are able to take on a full range of commercial real estate projects, from complicated mixed-use developments to simple land transactions.

Our law firm has represented hundreds of clients in commercial real estate transactions including matters related to shopping centers, office buildings, multi-family developments, industrial/flex buildings, single-family subdivisions, resort developments, hotels, and farms and ranches. We have the knowledge and experience necessary to handle complicated mixed-use projects and "new urban" communities. PackardDierking has a reputation for top-quality legal representation, focusing attention on each detail of your real estate transaction or development project:

Purchase and Sale: At PackardDierking we assist our clients with each step of the purchase and sale process, from initial negotiation and drafting of a letter of intent to completion of post-closing items. We have broad experience with purchase and sale agreements, due diligence, title and survey review, conveyance documentation, and other closing matters.

Commercial Leasing and Management: We represent commercial landlords and tenants in the negotiation and drafting of leases, subleases, lease assignments, estoppel certificates, subordination non-disturbance and attornment agreements, and other lease-related matters. We act as general outside counsel to a number of office parks and shopping centers, assisting them with day-to-day leasing and management matters. We also represent many corporations and businesses in connection with their leasing and facilities issues.

Real Estate Finance: Our lawyers represent both lenders and borrowers in connection with commercial mortgage transactions, ranging from acquisition loans to construction loans to permanent loans. Our experience includes traditional bank loans, life insurance company loans, and securitized loans. We also assist our clients in obtaining and structuring equity and debt-equity hybrid investments to finance their projects.

Zoning, Planning, and Entitlements: We have experience representing developers and property owners in connection with all types of development approvals, zoning, and other land use matters. We have a hard-earned reputation for our ability to obtain favorable entitlements from some of the most anti-development jurisdictions in Colorado. We also have broad experience with growth-control legislation and affordable housing measures that may affect development.

1031 Exchanges: Attorneys at PackardDierking are proficient in tax-exempt exchanges of real estate under Section 1031 of the Internal Revenue Code. In addition to handling dozens of routine 1031 exchanges, we have experience with reverse, title holding, improvement, ground lease, and other sophisticated exchange transactions.
