Jim Nikolai

NIKOLAI & MERSEREAU, P.A.

Jim studied at the University of Minnesota for his undergraduate degree and at William Mitchell College of Law for his Juris Doctorate degree. He became a member of the Bar of the State of Minnesota in 1982. He is a member of the Dakota County Bar Association, the Minnesota State Bar Association, the American Bar Association and the Minnesota Intellectual Property Law Association. Since joining Nikolai & Mersereau, P.A., Jim has concentrated on litigation matters and has successfully represented both plaintiffs and defendants. He also has substantial experience in the areas of trademarks, copyrights and software protection. Jim is a recognized leader. He was elected four times by the residents of northern Dakota County to its School Board. He served for many years as the School Board Chair. He was appointed by the U.S. District Court for the District of Minnesota to, and served on, the 2005 Patent Advisory Committee. This committee recommended the local rules the Court now uses in patent litigation.

Successfully represented clients in federal and state court, before the United States Patent and Trademark Office, and in arbitrations. Successfully represented jewelry designer in prosecuting multiple copyright infringement claims in federal court. Drafted and negotiated asset transfer agreements and licensing agreements for jewelry designs, computer software licenses, patent licenses, and settlement agreements. Provided legal opinions on trademark clearance search reports. Prosecuted trademark applications for goods ranging from jewelry, education consulting services, concert promotion, books, ceramic pots, clothing, business consultancy, security services, computer education training, metal vices, music performance, and restaurant services. Represented both Plaintiffs and Defendants in state and federal court in trademark infringement, Lanham Act, Minnesota Unfair Trade Practices Act cases. Represented both Plaintiffs and Defendants in federal court in patent infringement cases. Represented both applicants and registrants before the Trademark Trial and Appeal Board of the U.S. Patent and Trademark Office. Drafted patent applications and assisted in prosecution of multiple patents in the fields of kitchen storage devices, lathes for machining piping, and metal vices. Prosecuted copyright registrations for a variety of different media and tangible items, including jewelry, books, computer software, music recordings, photography, and websites. Represented both complainants and respondents before the National Arbitration Forum in Uniform Domain Name Dispute Resolution proceedings.
