Auto Accident

At Miller & Hopp Attorneys at Law, we have negotiated hundreds of fair and just settlements for auto accident clients. Please contact Miller & Hopp Attorneys at Law today for your free injury consultation. You don't pay unless we get money for you.

Car accidents are emotionally, physically, and financially devastating.
Oregon is one of the safest states in the country when it comes to auto accidents. But unfortunately, people still drive carelessly, under the influence, or aggressively. Even with Oregon's strict seat belt and cellphone use laws, accidents still happen. Car accidents are one of the leading causes of injury and death in Oregon. Most of those accidents are the direct result of another driver's thoughtless behavior behind the wheel. Roadway departures and speeding account for a large number of fatal car wrecks in the state.

When you're injured in an accident, the injuries you sustain aren't just physically painful. They often result in financial devastation. On top of that, our clients often come to us afraid to drive after the fact and consumed with anger and a feeling of injustice from what's happened to them.

We understand how devastating and unfair a car wreck can be for you and your loved ones. When you contact Miller & Hopp Attorneys at Law, we'll give your personalized, fast attention. We'll carefully listen to the details of your case. Our Oregon car accident lawyer is here to provide you diligent legal representation. Our legal team is knowledgeable and skilled at moving your auto accident injury claim along through either arbitration, mediation, a settlement, or a trial. We've successfully won numerous fair and just settlements for our auto accident clients in Oregon.

Trucking Accident

If you've been injured as a result of a truck driver's carelessness, please contact the law office of Miller & Hopp today. We don't charge you unless we get money for your claim.

Oregon Truck Accident Lawsuits
Truck accidents are incredibly different than car accident cases or other personal injury claims. For one thing, these lawsuits are governed by a multitude of complex state and federal laws. Trucking industry practices, the science of handling a massive vehicle on the roadway, and trucking experts are all involved in these types of lawsuits.

A large semi truck requires a different skill set to drive safely. A person with a regular driving license cannot legally drive a truck, and they have to have specialized training and knowledge to get behind the wheel of a semi-truck. Truck drivers have to be aware of the road conditions, and the way their truck and the load they're carrying will react to the highway. They also need to be mindful of other truckers, cars, motorcycles, pedestrians, and bicyclists. Careless driving as a trucker can be fatal to other people on the road.

Truck Accident Settlement
Because of the complex nature of trucking cases, insurance companies want to settle for as cheap and as quickly as they possibly can. They are thrilled when a trucking accident victim who has no knowledge of industry practices and regulations in trucking contacts them for a settlement agreement. They often bulldoze individuals with shady negotiating tactics and fear mongering.

An experienced truck accident lawyer knows how to negotiate with the insurance companies to get you a just and fair settlement for your pain and suffering. We won't let them lose crucial pieces of evidence in your case, or try to cover up the fact that the trucking company played hard and fast with the rules. Our promise to you is quick, personalized attention to your case, and we won't charge a dime unless we get money for you. Contact the law offices of Miller & Hopp today for your free injury consultation.

Estate Planning

Oregon Will and Trust Attorneys Miller & Hopp Attorneys at Law provide help and guidance to families who have lost a loved one and need help administering their will or trust. We also help those who want to prepare or update their will or trust.

Although it can be a difficult topic, having a well-drafted and complete will or trust plan will ensure that your family and assets are protected should something happen to you. Without planning, you may be leaving vital decisions to the courts or angry disputes between family members.

Understanding the Difference Between Wills and Trusts
Wills and trusts are both useful estate planning devices that serve different purposes. Both can work together to create a complete estate plan. One of the main differences between a will and a trust is that a will goes into effect only after you die, while a trust takes effect as soon as it is created.

A will is a document that designates who will receive your assets at your death, and it also appoints a legal representative to communicate and carry out your wishes. In contrast, a trust can be used to begin distributing property before death, at death, or afterward. A trust is a legal arrangement through which a trustee holds the legal title to the property for a beneficiary. Also, a trust typically has two types of recipients, one that receives income from the trust during their life, and another that receives whatever is left over after the first set of beneficiaries dies.

At your death, a will includes any property that is only in your name. It does not include property held in joint tenancy or a trust. On the other hand, trusts cover only property that has been transferred to the trust. Therefore, for a property to be included in a trust, it has to be put in the name of the trust.

An additional difference between a will and a trust is that a will passes through probate, meaning that a court will oversee the will's administration. However, a trust circumvents probate and, therefore, does not go to court; this saves time and money.

Wills and trusts have their advantages and disadvantages. There are a number of factors that go into determining which avenue is best for you and your beneficiaries. Our will and trust attorneys have experience with all of the intricacies that go into these plans.

Will and Trust Attorneys
A will needs to meet certain legal formalities for it to be respected by the court of law. It needs to be written, duly witnessed, and executed correctly. You need to be aware of the will and trust laws in the state of Oregon. Miller & Hopp Attorneys at Law can:

Write a new will or update an existing one
Create an amendment to the original will document
Present the will in court
Assist in the final execution of the will
Contest the will if any situation arises
Navigating the intricacies of estate planning in Oregon can be complicated. Our trust lawyers are skilled experts in this field. We understand how to set up a trust, which includes:

Helping you set up a trust legally
Making sure that the trust is administered per your wishes
Ensuring that it is not neglected
Assisting you to cover all possible bases

A. Kathryn Wymore

When I decided to enter the legal field, I thought my background in science would lead me to practice in patent prosecution or environmental law. During law school, however, after interning at the U.S. Attorney’s Office for the Eastern District of Virginia, I became much more interested in criminal law and civil litigation.

Prior to joining the firm, I practiced in Arizona and Virginia in the areas of Construction Law, Real Estate Law, Planned Community/Homeowners Association Law, Landlord Tenant Disputes, Toxic Torts and Personal Injury. During law school and for several years after graduating, I worked in-house for a data services provider, primarily drafting and negotiating licensing contracts.

I fell in love with Oregon after a camping trip to the Columbia River Gorge and the Oregon Coast and seven years later was able to move here with my family. I enjoy hiking, camping, skiing and generally being outdoors.
