Estate Planning Overview

Without a doubt, estate planning is vital. Indeed, most individuals and families can benefit from at least some estate planning. This is true whether their assets range from a few hundred thousand dollars to over a billion dollars.

At Middleton Legal, we use a step-by-step approach to estate planning, designed to help accomplish your personal and financial objectives. We do this by taking the time to first gather and review the important facts regarding your specific circumstances. After the initial fact-gathering and analysis, we then take the time to explain your options in plain English so that you can make informed choices that allow us to specifically tailor your unique and highly individualized estate plan.

There is real value in having your estate plan prepared by a firm that focuses exclusively on estate planning and probate law. First, a properly prepared and executed estate plan can help prevent your family from going to probate court following your death. Without a properly prepared estate plan, after you pass away, government entities and agencies such as the state of California and the IRS will decide how your assets are distributed. It is doubtful that these agencies care about ensuring that your wishes are carried out, that taxes are minimized for your heirs, or that estate costs are contained.

Moreover, a properly prepared and performed estate plan can help you control who makes financial and healthcare decisions for you in the event you become incapacitated. Today, a disability can be more challenging for a family than the death of a loved one. Without an estate plan, someone unintended by you could actually petition the court and gain control over your medical care and financial affairs.

We are committed to ensuring that your personal and unique estate plan functions properly and as you intended. Some of the strategies we use in our estate planning practice are discussed below.
