I grew up with divorced parents. My father was a doctor, and my mother was a Medicaid public benefits clerk. I learned through the unique perspectives of my parents about the importance of protecting assets for professionals and about the lifeline that Medicaid provides to chronically disabled persons and their families.

My legal experience matches my unique perspective. Representing buyers and sellers for the purchase and sale of a business, mergers and acquisitions, and building family partnerships from the ground up enables me to see all sides and angles of particular plans and structures. I reflect on my unique perspective when counseling and advising business owners, professionals, physicians, and those who are comfortable but not rich as well as those struggling to make ends meet.

I offer you my time and attention as you and I review your family dynamics, net worth, asset structure, and your previous will or estate plan. If you have not signed an estate plan yet, the State of Texas has one written for you that may not be the one you would choose. Your asset protection plan may need to be more sophisticated or simpler than you thought. I help by asking the tough questions, not because I’m nosey or insensitive, but because the tough questions lead to the solutions you might not have realize existed.

Probate

Our probate attorneys represent, counsel, and guide executors and personal representatives in probate and trustees of credit shelter trusts and inheritance trusts to ensure fiduciary duties are fulfilled and the terms of the will and trust completed.

Have you ever personally changed the oil in your automobile? I have. It is one of those things that some people figure out, do themselves, and save money. It is also one of those things that can lead to very significant damage and high repair costs. I can tell you from my own experience that you must make sure the seal for the old oil filter is removed before you install the new oil filter. If you forget, like I did, there will be a big oil mess and a big price to pay to fix the engine.

The same is true for administration of a probate estate and dissolution and termination of a trust. It is possible for an individual to administer a probate estate or a trust without the help of a professional. It is not, however, advisable.

A probate personal representative, independent executor, and trustee all have fiduciary duties. The fiduciary duty is the highest duty imposed by law. The law requires that the personal representative, executor, and trustee follow the instructions of the will or trust and also to act in the best interests of the beneficiaries. Just like a mistake while changing the oil in your automobile is costly, a mistake made acting as personal representative, executor, or trustee is also expensive. A breach of the fiduciary duty will result in personal liability of the personal representative, executor, or trustee.

Todd Marquardt

Marquardt Law Firm, P.C.

Todd built the Marquardt Law Firm as a sole proprietorship on November 30, 2009 and converted to a Professional Corporation in 2011.

Marquardt received his bachelor's degree in government from New Mexico State University in Las Cruces, New Mexico earned his Juris Doctorate at St. Mary's University in San Antonio, Texas. It's no surprise, then, that he has chosen to run his practice across these two states, splitting his time between offices in Texas and New Mexico.

Todd worked for the Social Justice Clinic at St. Mary University School of Law as a Student Attorney for one year. During that time, he represented clients in divorce, child custody, and won an appeal with Social Security. Following law school and the Texas Bar Exam, Todd worked in a law office focusing on guardianship, a litigation law firm, and helped build a sole practitioner build an estate planning firm to six attorneys with comparable support staff.

Todd is the sole owner and managing attorney of Marquardt Law Firm, P.C. He built the law firm to accommodate clients so that people who need legal services have an advocate who is approachable and accessible. In order to do provide the best service, Marquardt Law Firm, P.C. has hired smart and compassionate team members who walk with clients through their legal issues. Todd relentlessly pursues excellence to make sure clients know the law firm is going above and beyond for them.

Marquardt's has developed a strong referral network throughout the legal industry. When potential clients come to him with legal issues outside the areas in which he focuses, he introduces those in need to an attorney Todd knows can handle their unique issue. Todd's goal is to never close the door on a relationship, whether the final answer lies within his office or elsewhere.

A family man and small business owner himself, Marquardt's mission is to help adult children care for their elderly parents and to advocate for business owners. Marquardt's wife and he are the proud parents of two sons and a daughter. Todd's mission is to serve God by leading his family, vocation, community and country with the gifts and talents God has given him. He enjoys golfing, watching baseball, and hunting. He is a member of the Rotary Club, active in his church, and involved with the San Antonio Coalition for Veterans.

Marquardt is a licensed member of the State Bar Associations of Texas, New Mexico, and San Antonio, as well as the National Academy of Elder Law Attorneys, Inc. and the United States Bankruptcy Court of the Western District of Texas. He is an accredited attorney with the Office of Veterans Affairs and Marquardt Law Firm is an accredited business with the Better Business Bureau.

Ms. Lastition has a passion for helping families prepare legal plans that will work for their family when it is needed most. Ms. Lastition has learned first-hand the devastating effect that poor legal planning can have on a family and will work daily toward Marquardt Law Firm, P.C.’s vision to become the preeminent, regional asset protection and wealth preservation law firm.

A graduate of the University of Florida in 2008 Ms. Lastition received her Law Degree in 2016 from the Nova Southeastern University Shepard Broad College of Law. Ms. Lastition has worked in the legal field since 2004 at one time working closely with and representing disabled veterans fighting for their disability benefits from the Veterans Administration. We are incredibly grateful to have Ms. Lastition as a member of the Marquardt Team and we are certain that she will add another layer of success to our quality driven firm.
