Divorce

What is your firm's point of view regarding clients educating themselves on legal issues?

There is nothing inherently wrong with a client educating themselves on legal issues so long as they remember a few important things:
1. The information you find may be wrong. Just because something is on the internet does not mean it is necessarily true.
2. The Information may not apply to where you are. While CA law may be interesting and have some similarities, TX law may be very different. For example, legal separation does not exist in state of Texas. You are either single or married in the state of Texas. And you are married up until the date that your Judge grants you your divorce.
3. Law is complicated. There is a reason attorneys in the state of Texas are required to have their undergraduate degree, a law school degree, and then have to sit for and pass a very difficult bar exam. Google is no substitute for legal training. This legal training helps attorneys to understand how the law applies to case facts and this helps us to advise our clients so that they can best understand the pros and cons of possible responses to their legal matter.
4. Knowledge alone doesn't win your case. If you understand the law but you don't understand the rules of procedure and rules of evidence then you will not be able to get the information that you have in front of a judge. Facts cannot help you if they are not able to be presented to the Judge or Jury.

What are your firm's strengths and style?

Lisa VanAuken prides herself on being a caring but firm advocate for her clients. She understands and tries to help her client's understand what battles are worth being fought and what battles do more damage than good. There are attorneys out there who will encourage you to fight all the battles. Why? Because the more you fight the more time and legal fees you incur and that helps the attorney's bottom-line, but that doesn't help the parties when they get to the end of the road and see that they have spent most of their community estate on legal fees and there is very little left to divide. There are some battles that absolutely have to be fought. But in many cases it makes more sense for the parties to focus on getting the information that they need to be able to negotiate a logical resolution. You will find Lisa to be reasonable, compassionate and truthful. She will tell you what you need to hear, even if what you need to hear is not what you wanted to hear.
