Most minor traffic offenses are considered infractions. Infractions are not criminal violations of the law and carry relatively minor penalties such as fines, and/or points on your driving records. Though every infraction is different; each does require the officer to come to court and testify as to what they witnessed and why you may be guilty of that infraction.

The advantage of having an attorney means that you will not have to take time off from your busy schedule to come to court to challenge this violation. Your attorney will represent you in court, review the evidence, and cross-examine the officer at trial, if necessary.

Unlike an infraction ticket that is handled in traffic court, a misdemeanor is handled in the Criminal Division of the court house. A misdemeanor is a serious criminal offense that is punishable by jail time of up to one year, includes higher fines, and the possible loss of one’s driving privileges. The court may also impose other penalties, such as required enrollment in a substance abuse treatment program or other program, victim restitution, license suspension, and probation.

In California, a DUI is usually a misdemeanor.

However, there are circumstances under which a DUI may constitute a felony, such as when:
-You are involved in a vehicle accident while intoxicated that causes injury or death to another;
-You already have three or more prior DUI convictions within 10 years;
-You have one or more prior felony DUI convictions

Born and raised in the heart of Los Angeles, Melody Rahimi is a native who never left the city she calls home.

Melody graduated with honors from UCLA in 2012 with dual degrees in Political Science and Middle Eastern and North African Studies. Melody went on to receive her Juris Doctorate in 2016 from the University of West Los Angeles School of Law.

Today, Melody Rahimi is an experienced Criminal Defense attorney representing individuals from all types of backgrounds, from young students who've had a lapse in judgement to individuals with much more complex circumstances and history.
