Property Division Community property belongs to both spouses together, but it is within the court's discretion to divide marital property in the way it decides is "just and right," taking into consideration the rights of the spouses and whether there are any children. In the area of commercial litigation, Mr. Smith regularly represents corporations and other business enterprises in cases dealing with business torts, employment law, and contractual disputes. In addition, he has substantial experience in both the prosecution and defense of a wide variety of more specialized claims, including those filed under the Texas Deceptive Trade Practices Act, the Texas Insurance Code, and the Texas Residential Construction Liability Act.
