John Michael McBride

After graduating from Southern Methodist School of Law and Emory University, where Michael received his undergraduate degree, he had the opportunity to clerk for a U.S. District Court Judge. As a clerk to a Federal Judge, Michael was introduced to both the inner workings of our judicial system as well as having a front-row seat to witness the high-stakes practice of law, watching the very best and sometimes the very worst lawyers in action.

As a published author on many topics relating to bankruptcy, Michael McBride is a seasoned professional ready to assist you with all your financial and business-related questions. Having previously practiced in large law firms both in Dallas and Fort Worth, Michael founded his firm in 1997 to better serve the needs of his clients. Michael’s firm has attained an AV rating, the highest rating for both ethics and standards and legal ability from his peers and judges.

Whether you are trying to preserve your equity in your home or business, Michael is in the best position to give you confidential advice based on the facts of your situation under the applicable law.

If you are a creditor who is caught in the snare of a customer’s, supplier’s, or tenant’s bankruptcy, Michael can provide you with the best prompt resolution to your bankruptcy issue. There are many legal remedies available for creditors throughout the bankruptcy process. Michael is familiar with all of those and together, you can choose the best course of action for your financial situation.

Michael’s long history of representing International Business Machines and IBM Credit, LLC as well as many lessors and lenders, large and small, gives him the confidence and knowledge to represent your institution in any leasing or lending scenario.

Having been an active member of the North Texas Board of Risk Management Association for many years, Michael is intimately familiar with the needs of institutional lenders.

Michael has extensive experience from both the debtor and creditor perspective involving many types of businesses, such as real estate, oil and gas, high tech, automotive, hospitality, and many others.

At one point in Michael’s career, Michael successfully handled over 12 large real estate Chapter 11 reorganization cases pending across the nation. These included a chain of hotels on the East Coast, high-rise office towers in Los Angeles and Colorado, as well as a chain of high-end health clubs in San Diego among others.

Michael has also represented many individual debtors successfully preserving exempt equity and obtaining a discharge of all unsecured debt, in many cases.

Throughout Michael’s career, he has represented hundreds of defendants in litigation arising out of bankruptcy cases. These typically include suits by trustees to avoid preferences and fraudulent transfers. Michael has represented several shareholders in suits where a debtor was seeking to set aside the shareholders’ interests or deny their equity in the business.

Assets can be purchased from or sold out of a bankruptcy estate. Michael has been involved on behalf of both sellers and buyers in such transactions. These transactions range from the sale of oil and gas properties to purchases of an entire operating business. When Michael first started getting involved in the transactional side of bankruptcy, he found that there was not much current literature on the topic and therefore wrote his book: Purchase and Sale of Assets in Bankruptcy.

Michael is also an experienced Mediator and Arbitrator. For these services, the fees are based on a sliding scale. So, depending upon the amount in dispute between the parties, fees can often be half of what others are charging for the same service. Having seen the high cost of litigation, Michael is always happy save the parties money and solve disputes outside the Courtroom.

Michael stays very involved in several volunteer projects which are close to his heart. He is currently on the Board of Directors for the Tarrant County Bar Association (“TCBA”), acting as a Chairman of the Membership Committee. Michael has previously held positions with the TCBA Bankruptcy Section, Texas Lawyers for Texas Veterans, professionalism committees, and others. Michael is also a member of the Dallas Bar Association and the DBA Bankruptcy Section. Michael is a former member of the American Inns of Court and a former Board Member of the Risk Management Association.
