Bankruptcy chapter 7 flat fees are $1400 for singles, $1500 for married couples filing together. Chapter 13 fees are $3500 for a 3 year Plan; $3900 for a 5 year Plan (but between $1500-$2500 down before filing) depending on the factors of each case. We have payment plans for chapter 7 and 13 and you can start the bankruptcy case process for $500 down (sometimes less- we are flexible in many cases). If hourly fees are needed in bankruptcy (rarely occurs) for extra legal work beyond typical cases the hourly rate is $250 per hour. Clerk filing fees and costs (about $350) are extra and additional to the attorney flat rate fees stated above.

Estate Planning

Wills and Trusts

Planning for the inevitable things in life is a very important consideration when thinking of your family and loved ones. You want the best for them. Making plans ahead of time gives you the peace of mind that your family and loved ones will be properly cared for because all your affairs are in order and they will not be burdened with unnecessary problems and court litigation upon your illness and/or death. You may not actually need a Trust and may only need certain documents. Perhaps you may only need a Power Of Attorney or Health Care Surrogate in your situation. Whatever your needs our experienced and knowledgeable staff and attorney will customize the documents based upon your needs, desires, or circumstances. Creating and setting up a Will, a Living Will or a Trust lets you focus on the truly important things like family, friends, and yourself. A consultation with the attorney will help you understand the benefits and costs to creating a Trust or Will or other documents that prepare for the future.

Florida Bankruptcy & Debt Relief Law Firm

Eliminate Your Debts & Get a Fresh Start / Protect Your Income, Assets, Family and Your Life. Bankruptcy will discharge most kinds of debts and liabilities, including most types of taxes (based on some factors). Many people view bankruptcy as almost morally evil, like they are stealing from their creditors. However, most of the commercial creditors have already made their money and profits from you. Most people file due to circumstances beyond their control. They want to pay their debts but they are unable to and the "hounds" do not stop "barking at them". Bankruptcy could not be evil when the law authorizes it and it was commanded by God in the Old Testament (Deut. 15) so people would not be extremely materialistic and not care about people anymore. Some creditors could not care if you have to live under a bridge, just pay them their money! People worry that filing for bankruptcy will ruin their credit rating and hurt their financial future. But, nowadays credit and loans can be obtained very quickly, often within a year or less since so many people have filed in the last few years and now one can only obtain a chapter 7 discharge once every 8 years. Call us to learn the facts and details! Bankruptcy is often a better choice than credit consolidation programs because in bankruptcy all discharged debts are not considered income with the IRS on your tax returns. Forgiven debt or smaller paybacks through lower interest rates in consolidation programs are usually required to be stated as income on your federal income tax returns. Call us to discover which would be better for you!

How did your firm decide on the primary area of practice(s)?

We started off practicing primarily in divorce/family law in 2004. When the economic collapse hit in 2008 and business started to become much slower the law firm decided to assist people in bankruptcy as the slow economy hurt them as well. Attorney Mitchell and the Law Firm knows and understands how you feel and suffer in these slow economic times. We also began offering services in Wills & Trusts as attorney Mitchell had studied these subjects much in law school.

What experience or education distinguishes your lawyers from others?

The law firm has over ten years experience in divorce & family law and four years in bankruptcy handling approximately 200 bankruptcy cases.

What distinguishes your law firm from others?

We provide our services to our clients in the best reasonable manner we possibly can and serve you in your case the way we would want to be served and worked for. Attorney Mitchell is a born again Christian who realizes his labor, work and efforts for you will be evaluated by the Lord who wants us to "consider others better than ourselves". What we do for others and our clients is what we are doing for the Lord, so we strive to provide you the best quality attorney services that we can.

I seek to maintain a high quality professional relationship with each of my clients. Being a sole practitioner attorney allows me to give each of my clients more personal attention. We provide our client's with copies of all documents we receive on their case. I graduated from Regent University School of Law in Virginia Beach, Virginia in May 1993. Regent was an excellent law school that taught law based on the Christian and Biblical viewpoint. I am licensed to practice law in Florida and I have been a member in good standing with the Florida Bar since May 1994. I was an associate attorney practicing family law and divorce for one year in Fort Myers at a family law firm in 2003-2004. I started my own law firm in May 2004, which began operations from home based on funding and it soon expanded into the current law office on Del Prado Blvd. in Cape Coral. Prior to law school I graduated from Florida Bible College in Hollywood, Florida after attending Florida State University in Tallahassee.
