Most people are not aware of the fact that if their health, short term disability, long term disability, or life insurance are provided through their employer, disputes arising thereunder are subject to the federal law of ERISA and thus exempt from state law. In most of those cases remedies may be limited, and the rules and regulations for pursuing those remedies different or more restrictive than people expect. Glenn Kantor, a founding partner in Kantor & Kantor, LLP, has spent nearly his entire 25 year legal career representing Plaintiffs in Health, Life, Disability & Long Term Care insurance disputes. His firm has become one of Southern Californias preeminent firms in this area of the law. Mr. Kantor was also at the forefront of litigation arising out of the Northridge earthquake. In 2001, Mr. Kantor successfully argued Vu v. Prudential before the California Supreme Court. The opinion in Vu v. Prudential has become a seminal case significantly expanding the protections offered insureds under California law.
Since 2007, Mr. Kantor has annually been named a Southern California Super Lawyer in the area of health, life, disability, and long term care insurance disputes. For the past seven years in a row, Mr. Kantor has supervised more litigation involving employer provided health, life, and disability benefits than has any other attorney in the State of California.
On July 18, 2012, Mr. Kantor was among the attorneys to receive the honor of being named to the Daily Journal's Top 75 Labor and Employment Attorneys, which has been referred to as a list of top practitioners in California. Mr. Kantor was recognized as a litigator specializing in Employee Retirement Income Security Act (ERISA) cases; however, his influence does not stop at the courtroom steps. The Daily Journal noted that Mr. Kantor had worked with California Insurance Commissioner Dave Jones to help draft a law banning discretionary clauses in insurance contracts. That law, passed in 2012, essentially prevents disability insurance companies from inserting language into policies that give them discretion to deny claims.
Mr. Kantor's favorite part of practicing law is participating in the mediation process. He conservatively estimates that he has represented in excess of 1,000 clients during mediations and settlement conferences.
