How frequently does your firm use mediation, arbitration, or collaborative law to resolve cases?

Our firm will engage in mediation in order to negotiate a settlement in a case where there is some issue of liability, or a challenge to claimed damages. Mediation can be a useful tool in offering a "neutral", or "outside" view of the strengths or weaknesses of a particular case. However, mediation is not always the endpoint of a case -- sometimes it is best understood as a guidepost, or a warning signal, to one side or the other, that their expectations are unreasonable.

Arbitration, on the other hand, is sometimes contractually required, and is the substitute resolution for a jury or a bench trial. Arbitrations, especially when they are binding, must be understood as the last resort, as a sort of miniaturized trial, and must be prepared for as such.
