Often the alleged victim suggests that s/he will feel better and everything will be OK if you just admit you did something. This happens prior to being charged, arrested, interviewed, and often before you are aware that there is a problem. The conversation is designed to get evidence from your mouth to convict you, including agreeing with the accuser on anything, that the accuser said no, that you knew the accuser's age, that you had sexual contact or sex, that you knew s/he was really drunk, and that you apologize for your actions. The conversation is being recorded by the police. The accuser has been coached by police about what to say and how to say it. The police are sitting in the same room as the accuser. If you get this call, politely hang up (immediately) and call an experienced sex crimes defense lawyer.

False Accusations - False sexual assault accusations are often found during divorce and custody battles. These are used by a parent to gain an advantage or to take revenge. Innocence will not protect you. Only an experienced sex crimes lawyer will. What distinguishes your law firm from others?

The way we prepare. We start with you, and what you saw, heard and felt. Other lawyers look at the police reports and ask you how you explain things. As if the police got it right. No, police reports are designed to make you look as bad as possible. They think they are right. I don't.

What experience or education distinguishes your lawyers from others?

I was Colorado Public Defender for 5 years. I tried everything there, with solid success. Most criminal defense lawyers in Colorado are former public defenders. It is a great place to learn.
After I left the PD's office, I started learning at the Trial Lawyers College. This is much different way to approach a case. We put things into action - re-enacting scenes of the case. This is often not in the police reports, it shows motives, emotions, as well actions. These ideas are what drive sex assault cases. What we can learn using this process is more persuasive than an inconsistent statement or an error on a fact. We don't just attack the prosecution story, we present our own story. Ours will be better because it will explain the emotions and motives, in context of story, as to why you are innocent.

How did your firm decide on the primary area of practice(s)?

I have seen too many people convicted when they should not be. I watch trials of colleagues, and the famous lawyers in the area, as well as cases that hit the press. I see people convicted when they should not be. I see it as a lack of investigation and story telling. I see the error as challenging the jury or even being angry with them.
Jurors are just people like us. They want to do the right thing. They have biases that suggest results. No one likes that there are sex crimes or other crimes. It scares them.
I try to bring them together and to be a trusted advisor to them. This requires listening, patience, understanding and always being authentic. I find jurors will understand why my clients did something morally wrong that is not illegal, and not punish them on the verdict, if we are honest and put things into the context of story.
