When suffer the loss of a loved one, the last thing you want to do is to go through a complex and stressful court proceeding. Unfortunately, for many people there is no option, and they get stuck going through the probate process. which is the court process necessary to manage and distribute your loved one’s estate. Hiring an experienced attorney to help you through this trying legal process is what you need to find relief for your family during a difficult time.

Probate begins after a person has died, and is basically the process of transferring the person's assets from their estate to their beneficiaries (usually their family) or creditors, all under the supervision of the court. Most people aren't aware that, even when there is a will, probate is still required. The process involves court verification of the existence and validity of any will, and distribution of the assets in the estate (money, property, real estate), either according to the terms of a will or according to the laws of intestate succession for the state. The laws of intestate succession are the default rules for how an estate is to be distributed to heirs if the deceased person failed to create an estate plan, and the probate process becomes more difficult when these laws have to be applied. Either way, a "personal representative" (called an executor or administrator in other jurisdictions) must be appointed, and that person will be responsible to the court for overseeing the probate process. The personal representative must take a course about the process and their responsibilities, and has certain legal duties in handling the deceased’s assets and estate.

Mr. Gerity has been admitted to practice law in Arizona State and Federal courts since graduating from the Arizona State University College of Law in 1994. He also is admitted to practice law in Colorado and before the United States Patent and Trademark office.

Prior to forming Israel & Gerity, PLLC, Mr. Gerity clerked for the Chief Judge of the Arizona Court of Appeals, served as a deputy public defender, where he received extensive trial experience, and worked for several years at a large civil litigation law firm in Phoenix. He then struck out to form his own firm, and also served as Of Counsel to a prestigious boutique commercial litigation firm. In law school, Mr. Gerity was an Associate Note and Comment Editor for the Arizona State Law Journal, received honors in legal research and writing, and was awarded Best Appellate Brief. Mr. Gerity received his Bachelor of Science degree from Colorado State University in 1990.

Mr. Gerity has taught classes and given presentations on a wide variety of topics, including teaching intellectual property at a national paralegal college and teaching a series of courses to management personnel at a top-twenty employer in the Phoenix area. He has handled over thirty trials and numerous appeals before the Arizona Court of Appeals, the Arizona Supreme Court, and the U.S. Court of Appeals for the Federal Circuit. Mr. Gerity's practice areas include business formation and representation, bankruptcy, estate planning and trusts, general civil litigation and commercial litigation, intellectual property and real estate.

Mr. Gerity is also the owner of several of his own small businesses and serves on the Board of Directors for two other businesses and a charter school. His direct experience with running small businesses gives him the kind of deep understanding of business matters that simply cannot be attained working at a big law firm for an entire career.

When he is not working, Mr. Gerity spends time with his family, and in his "free time" he volunteers for the Phoenix Fire Department as a licensed EMT and sings in a rock cover band.
