Over half of molestation-abuse accusations are false, yet this crime has the highest conviction rate of any felony charge. An accusation of child molestation can start in a custody battle and lead to juvenile and criminal cases. An anonymous accusation of abuse can lead to the removal of your children, to criminal charges, to separation from your spouse, and ultimately a prison sentence.
Your best defense is to understand the system you face and have the most experienced legal representation possible.prosecution uses severe potential sentences to extract plea bargains. However, some of these defendants are innocent.

The sentencing laws in child molestation cases are more severe than for murder. If you committed first degree murder of a child, you would be facing a sentence of 25 to life.

If you sexually touch without penetration two different children each under 14 years of age, each count carries 15 to life.
If there is one child who is 10 years of age or younger, and the defendant is age 18 or older, and there is some penetration no matter how slight, the sentence is 25 years to life per count.

If there is no penetration, only one child and that child is under 14 years old, the potential sentence is 8 years per count

The Team Leader fights for you in the courtroom attacking the prosecutions case using the case strategy & analysis,The Battle Plan, developed by the Chief Strategist in consultation with the entire Multi-Disciplinary Team.

Legal Motions are used to exclude inadmissible evidence that the prosecution is attempting to show the jury. This is based on The Battle Plan.

The key weapon at this time is cross-examination of the prosecution witnesses and the cross-examination elicits evidence supporting The Battle Plan.

The Team Leader then presents to the jury your side of the story using the case strategy and analysis, The Battle Plan developed by the Team.

This starts by the use of Legal Motions to ensures that the Judge allows into evidence your theory of the case, The Battle Plan. This is accomplished by using defense witnesses developed during the investigation to support The Battle Plan.

This is accomplished by the use of defense expert witnesses developed by the science officer based on The Battle Plan.

Each of the Team Leaders is a skilled trial attorney with between 20 and 40 plus years of trial experience. The think tank led by the chief strategist develops the The Battle Plan.


Cases are won based upon the Case Strategy also know as the Battle Plan. It is the role of the most experienced attorney in the Innocence Legal Team to study the case and develop the overall strategy for the case.
Juries are very forgiving to a child witness when it comes to inconsistent statements, failure to accurately recollect time, gaps in memory, misunderstandings, and factual errors. Normal methods of defending against a false criminal accusation rarely work in a child molestation crime.

The core of the case strategy is designed to answer the question that all jury demands to be answered.
If this is a false allegation, why is the child making the accusation?

Child molestation defenses are all about understanding family dynamics and relationships with significant others. Accusations are motivated by emotions that result from complexities and conflict within the family including extended family systems.


Cases are won or lost before the jury is even selected!
The prosecution routinely files evidence motions to exclude the defense from introducing the key evidence for the defense. They want to restrict you to deny the allegations, I did not do it, but limit you from explaining the emotional background that lead to the false allegations. They claim that the defense wants to smear the child and the evidence has no weight.

If you lose the prosecution motion, you lose the trial before the first juror is even called.
Appellate Attorneys are experts in researching the law and writing legal documents.
The Innocence Legal Team uses Appellate Quality Attorneys as our Trial Motion Attorneys to write our motions excluding irrelevant and prejudicial prosecution evidence while ensuring that relevant defense evidence is admitted.


The Chief Science Officer is trained in Medicine and in Mental Health.
The roles include:
(1) Studying the medical or psychological reports presented by the prosecution. This information and is then relayed to the Team.
(2) Finding and recruiting expert witnesses for the Innocence Legal Team based on the needs of the individual case to rebut the prosecutions expert witnesses.
(3) Recruiting expert witnesses to present the defense theory of the case.


The Chief Science Officer, Team Leader, and the Chief Strategist will collaborate to determine what fields of expertise will be needed to present the Case Plan or Battle Plan to the Jury.
Those experts will be chosen from:
(1) A list of approved experts previously used by the Innocence Legal Team and vetted to be of knowledgeable in their field and able to present complex issues to a lay jury.
(2) The Science Officer will locate and recruit new Expert Witnesses on new and unique issues that your case may present.
Expert Witnesses are well known in their field. They are objective and are seen by the jury as truth tellers.


The Paralegals role is to create and keep and update The System. Patrick Clancy, Founder of the Innocence Legal Team, developed The System and has been asked to teach it to others as part of Continuing Education approved and offered by the State Bar. The System is a methodology that is needed to organize enormous amount of all data/evidence for the entire case.


Sex crimes, especially child molestation, are far more difficult to investigate than any other crime. The false allegation cases are about the emotions in interpersonal relationships and the emotions that cause the breakdown of these relationships.

John Forsyth

John D. Forsyth is a San Francisco native. His education is entirely local: St. Brendan Elementary, Saint Ignatius College Preparatory, U.C. Berkeley and Hastings College of the Law.

John is a tribal enrolled member of the Covelo Indian Community in Mendocino County. His family still resides on the Hoopa Valley Reservation in Humboldt County. During law school John spent his summers working there for the tribal attorney and environmental protection division. That experience instilled his desire to stand up for the rights of those who lack a voice against the government.

After law school, John spent 2 years with the Alameda County District Attorneys Office assisting in the prosecution of white collar crimes. Since then John has dedicated himself to defending those accused by both state and federal agencies. In the last 20 years 90% of this work involved accusations of sexual misconduct and other serious violent felonies. Simply put, John handles cases involving human conflict and handles them well.

John has served on the faculty at the Stanford Law School Trial Advocacy Program and has served as a guest judge at the Stanford Law School Moot Court Trial Competition.


I was taught early on by one of my mentors that at the end of the day the only thing an attorney will get out his profession is his reputation. I believe this to be absolutely true.

Simply put, criminal defense lawyers perform a service to their clients. This is the same as any other professional providing a service. In these cases the lawyer serves as a guide through the overwhelming process known as prosecution. I take the job quite seriously and make sure that the one thing the client receives is my attention and time. If you call my office, I return the call. If you have a question, I make sure that it is answered to your satisfaction.

In order to provide the best service to my clients I do not do volume business. I have handled many high profile cases in my time. I do not seek out the press in an effort to self-promote my practice. For most of my clients their case is high profile enough for them without an attorney seeking headlines at their expense.

The defense of complex child molestation cases is a highly specialized field of criminal law that few criminal trial attorneys and even fewer appellate attorneys have mastered. It takes a sophisticated understanding of the entire spectrum of legal, social, and psychological issues in these cases to effectively represent the accused. David Carico is the only appellate attorney I know who understands all aspects of a child molest prosecution including investigation, trial, and post-trial proceedings. David regularly attends conferences, consults with experts, works with investigators, and corresponds with the leading scholars in child development, suggestibility, memory, forensic, medical, and other scientific fields in order to stay well-informed when it comes to the defense of complex child molest cases.
