Tax controversy cases have been our only area of practice since the firm's founding.

What experience or education distinguishes your lawyers from others?

Burton Haynes' experience as a Special Agent with the IRS Criminal Investigation Division provides unusual insight into IRS practices and procedures. In addition, Burton Haynes' experience as a Certified Public Accountant lends understanding to many of the more-technical aspects of tax law that some tax attorneys lack. This background, coupled with his more than 30 years of experience in the private practice of tax law, distinguishes Mr. Haynes from other tax practitioners.

Russell Haynes has worked for Burton Haynes as a legal assistant, paralegal, and as an attorney. Russell continued to work for the firm while he attended George Mason University law school at night. Although he graduated in the top 5% of his class and from the tax concentration program, his "real" training has come from years of apprenticeship with his dad. Russell has since become an authority on employment tax matters and the application of bankruptcy law to tax.

Russ' work focuses primarily on businesses with federal and state employment tax problems, including unpaid and unfiled employment, unemployment, and entity-level income tax returns. He also assists business clients with worker classification cases, whether brought by the IRS, Social Security Administration, Department of Labor, or state tax authorities. Russ has substantial experience helping business owners and employees with personal exposure to the Trust Fund Recovery Penalty and converted state tax assessments. He has successfully defended a variety of businesses from state and federal action in employment tax cases and has assisted individuals in avoiding or reducing their personal exposure to the business' tax problems.

Russ devotes the remainder of his time to helping individuals with a variety of tax problems, including unfiled returns and unpaid taxes. He, like his dad, is an authority on the treatment of tax liabilities in bankruptcy. He has successfully negotiated offers in compromise and installment agreements with the federal and state tax authorities, obtained innocent spouse relief for clients, and represented taxpayers during IRS and state tax audits. Russ has also assists helped taxpayers file claims for refund or abatement penalties. He has also assisted taxpayers under criminal investigation and charged with tax evasion, willful failure to file, willful failure to collect and pay over employment taxes, false statements, false claims, and conspiracy.

Russ is admitted to the Virginia Bar, the Virginia Supreme Court, the U.S. Tax Court, and the U.S. District Court for the Eastern District of Virginia. He is a member of the American Bar Association, the ABA Tax Section and the ABA Committee on Civil and Criminal Tax Penalties, the Virginia State Bar Association and VSB Taxation Section. Russ is also a QuickBooks ProAdvisor. He is married to another tax lawyer, Heidi Kordish Haynes, and has a daughter, Hannah. Before attending law school and entering the practice of law, Russell was a trained musician, with a Masters degree in music performance from the Cincinnati Conservatory and a Doctor of Musical Arts degree from the University of Texas at Austin. Russell is also an accomplished golfer, a former assistant golf professional in Austin, Texas. He still plays in charity tournaments in the D.C. area.

Since 1981, Mr. Haynes has been engaged in the private practice of law, and is licensed in Maryland, Virginia and the District of Columbia. He specializes in tax controversy work, including civil and criminal tax matters, civil penalties, tax litigation, and the representation of clients before the IRS Examination Division, Collection Division, Criminal Investigation Division and Appeals Office, as well as before the United States Tax Court. In addition, he serves as a financial analyst and investigator in internal corporate investigations and litigation, and has testified as an expert witness in cases for both the government and the defense.
