The firm was established in 1990, dedicated to assisting people in Eastern North Carolina suffering from financial difficulties, including threats of foreclosure or repossession, burdensome credit card debt, medical bills, tax obligations, and overall overwhelming debt. We have 4 attorneys and a full staff prepared to represent those needing debt relief through Chapter 13, Chapter 7, Chapter 11 or Chapter 12 bankruptcy.

The attorneys in our New Bern, NC location are J. Allen Murphy, Jonathan E. Friesen and Lindsay M. Parker. The attorney in our Wilmington, NC location is Patrick D. Riley. They have combined 45 years experience helping people obtain debt relief and a fresh start.

We represent debtors in the New Bern Division, Greenville Division, and Wilmington Division of the Eastern District of North Carolina Bankruptcy Court. These divisions cover approximately 30 counties in Eastern North Carolina from the South Carolina line to the Virginia line from Goldsboro, NC to the coast.

Bankruptcy

The focus of Gillespie & Murphy, P.A. is to help people obtain a fresh start from their financial burden through Chapter 13, Chapter 7, Chapter 11, and Chapter 12 bankruptcy.

Chapter 13 bankruptcy allows our clients to protect their property, house, vehicles, mobile homes, etc. while eliminating unsecured debt such as credit cards, medical bills, personal loans, and other similar debt. Chapter 13 stops foreclosures and threats of repossession and establishes a payment plan to cure any missed payments on the secured property to be protected.

Chapter 7 bankruptcy provides a way to eliminate unsecured debt such as credit cards, medical bills, personal loans, and some federal and state tax obligations while offering exemptions under either federal or state law to protect property such as homes, vehicles, furniture, tools of trade, etc.

Chapter 11 bankruptcy is designed for businesses and corporations to restructure their debt and continue operating.

Chapter 12 bankruptcy is designed to help fishermen and farmers who find themselves in need of financial relief and business restructure to be able to continue to operate and provide for their families.

How did your firm decide on the primary area of practice(s)?

When the firm was established in 1990, the founding partners, Kenneth R. Gillespie and J. Allen Murphy, saw the need in Eastern North Carolina for a firm dedicated to help individuals and families struggling with overwhelming financial burdens. The decision was made to dedicate the practice in the areas of bankruptcy, chapter 13, chapter 7, chapter 11, and chapter 12 to allow people to obtain a fresh start while protecting their property.

What experience or education distinguishes your lawyers from others?

The firm's four attorneys and competent legal staff have 45 years of experience helping people in Eastern North Carolina. We have represented individuals, married couples, and small businesses through the bankruptcy process. The attorneys are associated with the North Carolina Bar, Bankruptcy Section and the National Association for Consumer Bankruptcy Attorneys to maintain their credentials and keep up with changes in the law.

What distinguishes your law firm from others?

At Gillespie & Murphy, P.A., we do not look at our clients as merely case numbers, but as persons in need of individual care and assistance in regards to their financial challenges. We have a genuine concern for our clients and strive to guide them through what we know can be a stressful situation. Each case is handled by one attorney and one case manager throughout the entire process so the client will know who to contact and have ready accessibility for any need that may arise. Ultimately, our mission is to provide personal, capable, and reliable legal services and spiritual counseling to all of our clients recognizing that we are accountable to God for those whom He has entrusted to us.

Allen Murphy

Allen Murphy has lived in Eastern North Carolina all his life. He was born in Kinston, North Carolina where he completed high school. He settled in New Bern after graduating from Law School in 1985 He lives with his wife to whom he has been married since 1979. He has two grown children.

He has been practicing law since 1985. He is a partner in the law firm Gillespie & Murphy, P.A. which formed in September 1991. The focus of his practice is bankruptcy (Chapter 13 & Chapter 7 Debt Relief). Allen graduated with honors from Mount Olive Jr. College and continued his education at East Carolina University where he graduated with honors in political science. He was on the Dean's List at both Mount Olive Jr. College and East Carolina University. He obtained his legal education at North Carolina Central University in Durham, North Carolina, receiving his J.D. Degree in 1985 graduating Magna cum laude. He was on the North Carolina Central Law Review.

Allen is a member of the North Carolina State Bar being admitted to practice in 1985. He is a member of the North Carolina Bar Association, National Lawyer's Association and the Christian Legal Society, National Association of Consumer Bankruptcy Attorneys. He is licensed to practice in all courts in the state of North Carolina, U.S. District Court and Bankruptcy Court for the Eastern District of North Carolina, 4th Circuit Court of Appeals and the U.S. Supreme Court.

Allen, Jane, Lindsay and Jordan currently worship our Lord at Temple Baptist Church in New Bern, North Carolina. Allen is active in the Temple Drama Ministry Team and teaches a Bible Fellowship Group as well as other ministries within the church. He is active in the ministries of Focus On The Family, Family Research Counsel, Promise Keepers, as well as other Christian organizations.

Allen believes that you can be an effective lawyer while being an effective Christian.

Jonathan Friesen

Gillespie & Murphy, P.A.

Mr. Friesen's practice concentrates on commercial and residential real estate, business and corporate law, and Chapter 7, 11, 12 and 13 bankruptcy, workouts and alternatives to bankruptcy and social security disability. Mr. Friesen earned his B.A. and J.D. from the University of Nebraska at Lincoln. Prior to attending law school, Mr. Friesen managed farms for the agri-business corporation Murphy Family Farms, headquartered in Rose Hill, North Carolina, then the world's largest swine producer. Mr. Friesen was admitted to the North Carolina State Bar in 2003, and the Nebraska State Bar in 2005. Mr. Friesen is a Super Lawyers Rising Star for 2013.

Lindsay Parker

Lindsay Murphy Parker was born and raised in New Bern, North Carolina. She and her husband, Roger, now reside in the small town of Pollocksville, North Carolina with their daughter and furbabies.

Lindsay attended the University of North Carolina at Wilmington after high school, where she graduated with a Bachelor of Arts in Communication Studies in 2009. During her studies, she was employed by Gillespie & Murphy, P.A. as a legal assistant in their Wilmington location and began full time in their New Bern office after graduation.

She obtained her legal education at North Carolina Central University School of Law in Durham, North Carolina, receiving her Juris Doctorate in 2016. She immediately began practicing law at Gillespie & Murphy, P.A., with a focus on consumer bankruptcy law.

Lindsay is a member of the North Carolina State Bar, North Carolina Bar Association, and National Association of Consumer Bankruptcy Attorneys.

Patrick Riley

Gillespie & Murphy, P.A.

Patrick Riley grew up in San Antonio, Texas, but moved to North Carolina to attend college at Wake Forest University.

After a brief stop in England at Oxford University he attended Wake Forest for law school.

Patrick and his wife moved to Eastern North Carolina after law school.

Patrick enjoys helping clients navigate the legal process. He focused his practice on financial matters from day one.

Patrick has experience working on Chapter 7, 11, 12, and 13 bankruptcy cases.

He has represented individuals, businesses, local governments, and served as special counsel to a former Chapter 7 Trustee.

Patrick also has experience helping clients with estate planning and other financial concerns.

He became an Accredited Financial Counselor ® and enjoys educating clients about personal finance.

His book, "I Hope I Never See You in My Office" (ISBN 978-1-4580-9810-8) was published in 2011.

In the Spring of 2019 Patrick completed certification exams and is now a Board Certified Specialist in Consumer Bankruptcy Law.
