Together, w can and do make a difference for many thousands of elderly residents in these facilities. We believe that our elders - those people who cared for us - are especially deserving of our love, respect and compassionate care. We know that whenever our elders receive substandard care, it jeopardizes their health, dampens their spirit, and degrades their dignity as human beings. We believe that this issue affects everyone. We are all aging, and each of us knows someone who will need long-term care. We have learned that each time we hold a nursing home accountable for its misconduct, we not only help our client, we also help all current and future patients at the facility. OUR COMMITMENT * To treat our clients and their families with dignity, honor and respect. * To vigorously, aggressively and tirelessly fight for our clients to obtain the resolution they deserve. * To hold persons and business entities responsible for the damage that they cause. * To improve the quality of care our elders receive, one client at a time.

Nursing Home or Elder Abuse

There is No Excuse for Elder Neglect

Tragically, the neglect and abuse of elders and dependent adults is a serious problem. The treatment our loved ones receive is often very different from the "compassionate care" promised in corporate brochures and advertisements. The state of California has passed special laws to encourage victims of neglect and abuse, and their families, to hold long-term care facilities responsible under the law. By increasing the damages these victims can recover, such facilities are deterred from reducing the quality of the care they provide to their patients, simply to make more money. The attorneys at The Gebler Firm, PC believe that protecting elders and dependent adults from neglect and abuse is more than the practice of law it is a life mission. If you suspect someone you love has suffered physical or emotional injuries from neglect or abuse, contact The Gebler Firm, PC at 1-800-871-6998 for a free consultation, or fill out an on-line consultation request. Together, we can make a difference in the way our loved ones are treated.

Glenna M. Francis

The Gebler Firm, A Professional Corporation

Glenna M. Francis attended law school at UC Berkeley, where she began her legal career in plaintiff-side litigation. After graduation, Glenna was recruited by a large commercial law firm, but she missed making a personal difference in the lives of her clients. In February 2009, she returned to representing plaintiffs, focusing on our most vulnerable populations, the injured and the elderly. In Glenna's own words:

"I wanted my professional career to be about more than making wealthy people wealthier. Here at The Gebler Firm, PC, I found my true calling. Every day, I am given the opportunity to make a difference in the lives of our clients, one person at a time. We are in the trenches every day, fighting a legal battle to improve the quality of healthcare available to everyone who enters a long-term care facility in California. I love my job."

Glenna recently argued Birl v. Heritage Care LLC, 172 Cal.App.4th 1313 (2009) before the Second District Court of Appeal, regarding the applicability of CCP 1281.2(c) within the context of an elder abuse/neglect action. In its opinion, the Court upheld the trial court's denial of a petition to compel arbitration on grounds of joinder, finding: (1) an abuse/ neglect action filed against doctor defendants may arise out of the same transaction as that which involves a care facility, (2) services provided at one facility and separated in time from the services provided at another facility may still be "related transactions," and (3) plaintiffs may themselves qualify as third parties as to their individual causes of action.

Glenna attended law school at the University of California at Berkeley, Boalt Hall, and simultaneously plunged into the world of plaintiff-side litigation. She also volunteered as a mediator in a victim-offender reconciliation program, specializing in youth offenders referred by the Oakland Probation Department. Glenna believes that this experience taught her many valuable skills that she applies daily, including her ability to empathize and connect with people on a personal level, and to reach resolution even under extremely difficult and emotional circumstances.

When not in the office. Glenna tries to keep pace with her mom (a vibrant and active 82-year- old) and her son (a vibrant and active teenager).

Andrina G. Hanson

The Gebler Firm, A Professional Corporation

Andrina received her law degree from Loyola Law School in 1986, after serving as the Chief Justice of the Scott Moot Court and receiving an American Jurisprudence Award of Excellence. That same year, Andrina joined a civil litigation law firm, where she worked as attorney for over twenty years, representing plaintiffs in major injury cases.

Since 2000, Andrina has focused her legal career on advocating for the rights and safety of elderly and disabled people neglected by caregivers in nursing homes, senior living centers, retirement homes and group homes. In addition to successfully resolving many elder neglect cases by way of litigation and mediation, Andrina has authored two appellate court briefs that resulted in published appellate court decisions, Benun v. Superior Court (2004) 123 Cal.App.4th 113 and Birl v. Heritage Care LLC (2009) 172 Cal.App.4th 1313. Both have served to protect the rights of the elderly and the disabled.
