Whats in a name? At Fresh Start Family Law, we took great care in choosing a name for our firm. Having practiced exclusively in family law for over twenty-five years combined, we joined forces to create something new, exciting, and dynamic. The law is not set in stone; in fact, changes occur every day. We are a family law firm devoted entirely to family law matters involving child custody, child support, divorce, separation agreements, alimony, post separation support, pre nuptial and post nuptial agreements, adoption and domestic violence. Narrowing our field of representation to family law only affords us the ability to stay abreast of new developments and provide our clients with the most informed, up-to-date representation possible. Our philosophy is that the best way to grow a business is to do what is right for each individual client.

Fresh Start Family Law stands for the principle that everyone needs and deserves a fresh start at some point in their life – sometimes more than once. People move and build new careers. We make changes throughout our lives. Sometimes those changes are in our families, be they marriage, adoption, or divorce. The approach to separation and divorce does not require a smear campaign between spouses, spending money better used for securing the future and leaving children torn between their parents. While we are prepared to represent our clients in contentious litigation when necessary to protect your rights, it just isn’t necessary in most cases and delays the process of healing, moving on, and experiencing a fresh start in life.

Catherine Bailey received her J.D., cum laude, from Campbell University, Norman Adrian Wiggins School of Law, in 2005. She received the Award of Distinction from the North Carolina Chapter of the American Academy of Matrimonial Lawyers upon her graduation. After graduation, Ms. Bailey served as a law clerk to the Honorable Justice Edward Thomas Brady at the North Carolina Supreme Court before starting work as a private attorney.

Catherine is a Board Certified Family Law Specialist and a Certified Family Financial Mediator and Certified Superior Court Mediator. She is member of the Family Law Section of the North Carolina Bar Association. Catherine mediates family law cases and represents family law clients in all aspects of family law, including divorce, domestic violence, child custody, child support, alimony, equitable distribution, separation agreements, adoption, termination of parental rights, and surrogacy. She has a special interest in representing clients involved in military divorces, particularly military pension division. She also has a special skill as a certified mediator in assisting parties reach a resolution of their case without further involvement by the court.

Fall is the best season for Catherine. She loves the cooler weather and, more particularly, that it is football season! The Pittsburgh, Steelers are her team of choice; but really any football game is a good time for Catherine.

Kathy H. Lucas

Born and raised in New Jersey, Kathy Lucas is quick to point out she grew up in “South” Jersey. Her parents are from Hungary which makes Kathy a first generation American (she is, however, a Hungarian citizen as well). Growing up she participated in sports such as soccer and softball but equally enjoyed dance, cheerleading, mock trial and was a debutant. She carries forward in her practice this love for variety by being just as comfortable in court as with mediating her clients’ cases. She instead focuses on her clients’ needs, goals and interests and how they can be best met. For Kathy every client is important and is treated like a member of the family.

She attended The Richard Stockton College of New Jersey for her undergraduate studies. During her four year college career she double majored in Psychology and Criminal Justice, graduating Cum Laude in both studies, earned a minor in Political Science and held down two jobs. It is no wonder she also considers this time when she became rather proficient in the “art” of multi-tasking. She then received her J.D. from the Adrian Wiggins School of Law at Campbell University. While attending law school Kathy decided she liked North Carolina so much that she would make it home.

Kathy’s practice is exclusively devoted to family law and domestic cases including child custody and support, post separation support, alimony, equitable distribution, separation agreements, collaborative law and absolute divorce. She is a member of the Family Law Section of the North Carolina Bar Association and the Wake County Bar. In 2011, Kathy challenged her aptitude in domestic law by sitting and passing the test required by the North Carolina State Bar to be recognized as a Board Certified Specialist in Family Law.

She lives in Raleigh with her husband and children. When she’s not working Kathy enjoys getting her hands dirty in the yard with various landscaping and gardening projects. She also enjoys traveling with her husband and going on family adventures with the kids!
