A full-service consumer protection law firm that handles automobile repossession, debt collection, debt defense, student loans, and credit reporting errors.
Car Repossessions : The State of Wisconsin governs how vehicles may be repossessed. The creditor can either obtain a court order requiring the return of the vehicle, or they can obtain the vehicle via âÂÂself-helpâ methods. To repossess a vehicle via âÂÂself-helpâ they must: 1. provide a written notice of your right to cure. 2. not breach the peace when repossessing the vehicle. A breach of the peace occurs when you protest the taking (even if you just calmly state âÂÂdonâÂÂt take my vehicleâÂÂ) and the vehicle is taken over your protest. If this has happened to you, we would love to talk with you to see if you have a basis for a lawsuit against the creditor or repossession agent. Credit Reporting Errors: Do you have errors on your credit report? Are there accounts listed that are not yours? Are there balances listed incorrectly? Are there accounts that are too old to be there? Does it say you have a judgment that isnâÂÂt yours? Does it report you as deceased when you are still alive? Is there a balance listed after bankruptcy? Is someone elseâÂÂs information showing up on your report? If you answered yes to any of these questions or have a similar situation, we may be able to help you. The Fair Credit Reporting Act requires the credit reporting agencies to have reasonable procedures to allow you to have an accurate report. Additionally, if there is an error on your report and you dispute it with the credit reporting agencies, you may have a basis for a lawsuit against the credit reporting agency or the creditor that posted that information if it is not corrected. If you need help with incorrect information on your credit report, we are only a call away. We will meet with you over the phone or in person to discuss your situation. This meeting is free of charge. Debt Collectors and Debt Defense: Are you being harassed by a debt collector? Did they say something untrue to collect a debt? Are they placing undue pressure on you? Are they calling multiple times a day? Are they threatening you with things that you arenâÂÂt sure whether or not are legal? Do you want to make sure that your rights arenâÂÂt being violated? We would be happy to talk with you. Student Loans: With education costs increasing, many people find themselves with student loans that they are unable to pay. The good news is that for federal loans, you may be eligible for an income based repayment plan. Need help with this? Just give us a call. Or maybe your student loans have been turned over to a debt collector? Is that debt collector trying to unfairly collect? Give us a call and schedule your free consultation!
