Drunk driving offenses carry severe, often devastating penalties for convicted motorists. You need lawyer David Mansfield to advocate for your rights when you need it most. Drivers suspected of inebriation are pulled over and put through a series of tests, including a test to determine the driver's blood alcohol concentration (BAC). If your BAC is above 0.08%, you will most likely be charged with driving while intoxicated (DWI).

If your BAC is 0.05%0.07% or you show other evidence of impaired abilities, perhaps from prescribed drugs, you could be charged with driving while ability impaired (DWAI), a lower-level charge of DWI. It may be in your best interest to fight these charges every time because penalties are severe and plea bargaining may not be an option. DWAI involving drugs is a misdemeanor offense. Refusing a chemical test to assess your BAC can result in a one-year loss of license and a $500 fine.

-Conviction of a third offense of DWI or DWAI can result in up to $10,000 in fines and up to seven years in jail.

The first offense of driving is considered a misdemeanor crime, but subsequent convictions within 10 years are felonies.
