Islandia attorney helping you get back on the road

With even the slightest distraction, a simple drive can turn disastrous. Taking your eyes off the road, failing to yield to another vehicle, or having a little too much to drink before getting behind the wheel are common causes of traffic stops and in worse cases, collisions. These incidents are stressful enough without worrying if you will have to go to jail, lose your license, and for commercial drivers, lose their jobs.

If you receive a traffic ticket or are charged with a crime such as DWI, you need an experienced Long Island lawyer who can properly set your expectations and advise you on how to resolve your moving violation case involving the following charges:

-Driving while intoxicated (DWI)
-Driving while ability impaired (DWAI)
-Reckless driving
-Driving without proper insurance
-Driving on a suspended or revoked license
-Aggravated unlicensed operation
-Repeat traffic offenses
-Car, truck and motorcycle accidents
-Commercial drivers license matters (CDL)
-Trucking safety violations
-Representation in DMV administrative hearings

David A. Mansfield, Attorney at Law also provides criminal defense for misdemeanor crimes. In this area as well as his traffic cases, Mr. Mansfield keeps in touch with clients throughout their cases, including handling payment of fines and court fees.

Drunk driving offenses carry severe, often devastating penalties for convicted motorists. You need lawyer David Mansfield to advocate for your rights when you need it most. Drivers suspected of inebriation are pulled over and put through a series of tests, including a test to determine the driver's blood alcohol concentration (BAC). If your BAC is above 0.08%, you will most likely be charged with driving while intoxicated (DWI).

If your BAC is 0.05%0.07% or you show other evidence of impaired abilities, perhaps from prescribed drugs, you could be charged with driving while ability impaired (DWAI), a lower-level charge of DWI. It may be in your best interest to fight these charges every time because penalties are severe and plea bargaining may not be an option. DWAI involving drugs is a misdemeanor offense. Refusing a chemical test to assess your BAC can result in a one-year loss of license and a $500 fine.

Without vigorous and knowledgeable representation, you are likely to face the maximum penalty:

-First offense of DWI and DWAI can incur fines of more than $1000, driver's license revocation, and up to one year of jail time. Mandatory installation of an ignition interlock device (IID) may be required for a first offense conviction, as well as the possibility of three years probation.

-Second offense of DWI and DWAI comes with a jail term of up to four years and maximum fine of $5000 (if convicted within 10 years of first offense)

-Conviction of a third offense of DWI or DWAI can result in up to $10,000 in fines and up to seven years in jail.

The first offense of driving is considered a misdemeanor crime, but subsequent convictions within 10 years are felonies.
