Duane W. Smith was born and raised near Bertrand, Nebraska. He graduated in 1972 from Nebraska Wesleyan with a Bachelor of Science Degree in Physics and Supporting Fields of Math and Chemistry. He earned his law degree from the University of Nebraska College of Law in 1977. He has practiced law with the firm from 1977 to the present date. He served in the United States Army from 1972 to 1974.

Mr. Smith is actively involved in public service, serving on the boards of directors of Museum of Nebraska Art, Nebraska Public Radio Foundation, Education Service Unit No. 5 of Nebraska, Beatrice Public Library Foundation, Southeast Nebraska YMCA Foundation and Centaury United Methodist Church, Board of Trustee.
