Employment Law & Litigation

The Employment Law practice at Cremer Spina covers a wide range of areas, from counseling and training clients and their employees to litigating cases. Our philosophy is that the best employment claim is one that is never filed. To that end, prevention is the first line of defense. We strive to counsel and train our clients in all aspects of employment law issues.
We draft and review employee handbooks, manuals and employment contracts tailored to our clients' specific needs. We are readily available to assist our clients when issues arise that require immediate attention. When the unfortunate situation arises and layoffs are necessary we assist our clients in properly reducing their workforcesfrom offering advice on how to select employees in a non-discriminatory manner to drafting severance agreements.

We provide comprehensive training on how to recognize and prevent harassment and discrimination in the workplace and how to deal with it when it occurs. We also provide training for management in all aspects of day-to-day employment issues, from advertising for employment, to interviewing, hiring, conducting performance evaluations, disciplining and terminating. We teach our clients how to properly document issues that arise and when and how to investigate employee complaints.

Recognizing that not all claims are preventable, our employment attorneys have a wealth of experience in litigating a wide variety of employment claims both in Federal and State court as well as various Federal, State and local administrative agencies. We counsel our clients on the available methods of alternative dispute resolution, including mediation and arbitration. We work to resolve cases in the most expeditious and efficient manner and in a way that suits our clients' best interests. When pre-litigation or pre-trial settlements are not feasible or warranted we stand fully prepared to litigate the case to the end.
