Beneficiaries, including the spouse, child, parent, grandparent, or a dependent relative may bring a claim for damages after a wrongful death accident within two years of the accident. Virginia courts allow recovery for a wrongful death action in an amount believed to be "fair and just." This amount can include the following: Compensation for the lost wages and future earnings provided by the deceased Medical expenses Funeral expenses Loss of consortium Punitive damages to ensure the conduct does not happen again Virginia does not provide for a cap on the value of a wrongful death action, aside from punitive damages, for wrongful death actions which occurred as a result of an accident, like car accidents. However, a cap is provided in cases where a loved one was killed due to the actions of a medical professional. The medical malpractice cap is $2,000,000 for wrongful death actions, including all medical bills, funeral costs, and other damages. When considering the amount to award a family, a court may consider the impact of the loved one on the family structure, the family income, and the related expenses caused by the accident. What distinguishes your law firm from others?

Our founding partner, Damon Pendleton, spent five years working for the largest auto-insurance carrier in Virginia where he learned every trick in the book that insurance companies use to give injured victims as little money as possible. Mr. Pendleton couldn't stand this behavior because he saw that even though people had legitimate claims, the insurance company didn't care. The name of the game was how cheaply you could close out a case. Permanent injuries? Death? Future medical bills? None of that stuff matter to the insurance company. Time and again Mr. Pendleton saw that many attorneys weren't equipped to fight the insurance companies because they didn't know how the insured company valued their cases or what kept them up at night. Thankfully Mr. Pendleton finally got fed up and started working for the other side. Now, his clients don't have to be the victims to an auto-insurance industry gone wild.

Christina was born in Taegu, the fourth largest city in South Korea. She first moved to the United States as a child for several years while her father pursued his doctorate degree in Maryland. Christina returned to Korea for some time and then later moved back to the United States during high school, this time living in Cary, North Carolina. Christina has played piano from the age of 4 and upon graduation from Cary High School, she attended University of North Carolina-Chapel Hill on a classical piano performance scholarship.

While Christina maintains a passion for music, she chose a career in law. During law school at North Carolina Central University, Christina served as a law clerk at the North Carolina General Assembly and at the Durham County District Attorney's Office handling General District Court matters.

After passing the bar exam, Christina worked for a high-volume traffic and criminal law practice serving central Virginia. This allowed Christina to help thousands of clients and gain a wealth of experience in a short period of time which she continues to use as a Richmond personal injury lawyer to help clients in the counties she serves. Christina speaks Korean fluently.

Christina is admitted to practice in Virginia, Washington D.C., and Fourth Circuit (Eastern District of VA and Western District of VA) as well as the United States Bankruptcy Court.
