What do we mean by mediation, negotiation, litigation and consultation? What do we mean by a personalized approach?

At the 30,000 viewpoint, the issues in most matrimonial cases are the same - division of assets and debts (equitable distribution), spousal support (including alimony and maintenance), child support, custody and visitation and litigation costs. These are the issues that need to be resolved before a judgment can be granted. Bring that viewpoint down to your case and its more complicated. We have real life problems - how to pay bills on one income, how to separate finances, how to pay the babysitter, how to share holidays with my soon-to-be ex, is he or she hiding money, what is going to happen next? At the Law Offices of Bonnie Mohr Jan, PLLC, we sit down and have a conversation (face-to-face, Zoom or phone) and go through each of these issues at a personal level. During this conversation, we also determine what is most important for you - to get a bigger piece of the assets, to get your spouse to pay all of the debt, to get primary custody of the children, to get the divorce finished as fast as possible. Once we know your issues at a personal level and your most important goals, we can develop a case strategy that works for you. The Firm does not guarantee we will get you the results you want, but we will work with you to give you realistic expectations, possible outcomes, and honest answers.

The case strategy is implemented using mediation, negotiation, litigation and consultation. The attorneys at the Firm can mediate your case - meaning you and your spouse are guided through a conversation to resolve these issues, negotiate your case in or out of the courtroom - meaning your attorney represents your interests and negotiates a deal to resolve all issues, litigate your case - meaning your attorney will resolve your issues in the court system and guide you through your case (consultation) where you are your own attorney - meaning that you are doing all of the work and your attorney is coaching you how to do the work.

If your case is in Family Court or its a more limited issue, we can help with that, too, with the same approach. We have a conversation to explore the issue(s), what you want to accomplish and how you want to accomplish your goals. We will also give you honest answers about what can and cannot be accomplished in the court system.

Matrimonial and Family Law. Typical cases include contested and uncontested divorces, child support, custody and visitation, paternity, prenuptial and postnuptial agreements, parenting agreements, judgment enforcement and modification.

The Firm is open and taking new cases during the COVID-19 pandemic. All meetings will be conducted by phone or Zoom. Now is a good time to gather those documents and explore options.

Results oriented law firm. We work with our clients to explore options, reach goals and educate. You have some difficult decisions to make. We want to help you make those decisions and implement those decisions with long-term, positive results. Examples of long-term, positive results are an access schedule that minimizes parental conflict, division of assets the minimize transfer and liquidation costs, collateral damage in a settlement agreement so each side has an incentive to comply with the terms of the deal.

Divorce Mediation

Resolution oriented law firm. We want to help you through a difficult conversation. The difficult conversation could be in the context of a divorce action, parenting issues, prenuptial agreements or changes to a settlement agreement and more.

The Firm is open and taking cases during the COVID-19 pandemic. All cases will be conducted through Zoom. Zoom can be conducted on a computer or cell phone, allows the mediator to meet individually with each participant during the mediation sessions, allows for screen sharing documents, and allows for greater flexibility in scheduling mediation sessions.

Bonnie Mohr Jan is an experienced mediator and divorce attorney. Bonnie brings this knowledge, along with a great deal of empathy, to her mediation practice. Bonnie will help you have these difficult conversations and help you reach a resolution that is acceptable to both participants. From her years of experience, Bonnie can also alert you to "solutions" that have been problematic for certain individuals, the possible outcomes if litigated and "standard options" that have been achieved in prior cases.

How did your firm decide on the primary area of practice(s)?

The Firm focuses on matrimonial and family law because these areas of law are people focused and resolution focused. Even in the litigation context, the primarily objective for the lawyers and the courts is to help these individuals resolve their case. We want to help you reach a long term, beneficial resolution so you can move on with your life and we want to do this as quickly and painlessly as possible.

What is your firm's point of view regarding clients educating themselves on legal issues?

Client's should be educated. Client's need to make a difficult decision and more education is almost always better. (At some point, a decision will need to be made with the information at hand. You can't know everything.) To the extent the client is already educated, the client can then make more use of the attorney's time in exploring options and implementing strategic decisions.

This does not mean that the client should go out and learn everything there is to learn. Its a great idea to come into a meeting with your attorney after doing some homework on google with general searches. If you need a more sophisticated education, let your attorney point you in the right direction.

Is your firm willing to coach clients who want to represent themselves?

The Firm does coach clients in a variety of contexts - when clients represent themselves in court, when clients need help with legal documents, when clients are going through mediation. The Firm has guided many individuals through a variety of legal problems and will continue to do so.

Bonnie Mohr Jan is a matrimonial and family law attorney because the shoe fits. Bonnie utilizes her intuition and empathy to guide her clients through any number of complex legal issues that usually have a fundamental base in people and their tendencies. This intuition allows Bonnie to guide her clients to decisions that work. For example, Bonnie coached a wife to waive any interest she may have in her husband's business if he waived any interest he may have in her retirement account because he poorly ran his business and the business documents clearly were never going to be available. You cannot determine the value of a business if the business cannot produce the business records. Bonnie has guide individuals to litigation where a spouse is never going to commit to a decision and mediation or negotiation just will not work if the parties cannot make a decision. Bonnie has also helped her client's structure parenting plans that fit a lifestyle and minimize a parent's "failings". For example, if a noncustodial parent is never going to take the children to a Saturday morning activity, then the parenting exchange should happen after the Saturday morning activity except to accommodate special weekend plans.
