A conviction for driving under the influence (DUI) in California can have very serious consequences, even for first-time offenders, including but not limited to jail time, fines and penalties, suspension of your driver's license, mandatory classes and meetings, and probation. There can also be a long list of collateral consequences, including a 10-year DMV conviction record, higher auto insurance premiums, and employment challenges. Depending on the circumstances of the DUI offense, charges could be filed as either a misdemeanor or a felony. In felony DUI cases, there are much stiffer fines, penalties and the possibility of prison time. If this is your second or third offense, these penalties can escalate even further. It's important to understand that a DUI charge can result from driving under the influence of either alcohol or drugs. The legal alcohol limit for adults is 0.08%, if you are a minor, there is zero tolerance in the state of California. Penalties for multiple DUI offenses The penalties for subsequent DUI convictions are severe. The severity of penalties depends upon the number of DUI offense you have been convicted of in the past 10 years. These penalties are as follows: -2nd offense up to 2 years in county jail, license suspension of up to 2 years -3rd offense 4 months to 1 year in county jail, license suspension up to 3 years -4th offense 6 months to 3 years in county jail or state prison These may include counseling or alcohol abuse classes, fines up to $1,000 and probation. Our primary concern is protecting your rights and your future. During the initial consultation concerning your case we can answer your questions and will work with you to plan a solid defense strategy. A standard DUI retainer will cover, not only court appearances for the DUI, but also the DMV hearing, which needs to be requested within 10 days of the arrest in order to avoid suspension of your license.
