When Do I Have to Pay Overtime?

Federal and state laws require most employers to pay overtime. These laws contain many exceptions, so not all employees are entitled to overtime. Employees who are eligible for overtime are called “non-exempt” employees, and those who are not eligible for overtime are called “exempt” employees. An employee who works overtime must be paid "time and a half" -- the employee's usual hourly wage plus the 50% overtime premium -- for every overtime hour worked.

Have the overtime rules changed?

I've heard a lot about new overtime rules, but the things I'm hearing seem to contradict each other. The government seems to be saying that more workers are eligible for overtime now, but labor unions say the rules are bad for workers. What do the new rules actually require?

Time off work for illness. Most employers provide for some paid sick leave, although no law requires them to do so. Under the Family and Medical Leave Act, however, a worker is guaranteed up to 12 weeks per year of unpaid leave for severe or lasting illnesses.
