An Overview of Chapter 13 Bankruptcy

Chapter 13 bankruptcy, sometimes called reorganization bankruptcy, is quite different from Chapter 7 bankruptcy (which wipes out most of your debts). In a Chapter 13 bankruptcy, you use your income to pay some or all of what you owe to your creditors over time. Not everyone qualifies for Chapter 13, however -- and some debtors would be better off filing for Chapter 7.

I filed a Chapter 13 bankruptcy and have already started paying the court. I sent a payment to the bank for a note owed on my van, but the check was returned. They then came and picked up the van. My work material was in the van along with personal items -- and we have not yet been notified as to where they are. What legal recourse do we have against the bank?
