Example casesAttorney Nichole Flippen has litigated claims arising from collection of assessments, covenant disputes, contractual issues, and property damage claims; advised clients on legal matters unique to community associations, including covenant enforcement, assessment increases, parking regulation and insurance coverage; prepared and reviewed policy resolutions and other legal documents; prepared and negotiated service contracts; represented clients before state and county regulatory boards; and opposed zoning applications adversely affecting community association clients and their members. In a recent case, Nichole defended a condominium association against a claim of racial discrimination in the collection of condominium assessments. She successfully defeated the discrimination claim and moved forward with litigation to earn a court award securing the association's claim for more than four (4) years worth of delinquent assessments. Nichole also has experience representing community associations before government agencies and community association regulatory boards. In an action before a local regulatory board, she assisted in defending a condominium against allegations that the condominium violated state law by not allowing an individual unit owner to review certain private association and unit owner documents. Nichole, along with another attorney, successfully defeated the claim against the condominium and prevented the disclosure of the protected information. In representing business clients, Nichole has: litigated commercial debt collection actions, property damage claims, contract disputes, landlord/tenant actions, and employment disputes; negotiated favorable settlements; and advised clients on corporate litigation issues and general business matters. |
