Salinger Case Vacated and Remanded

The district courts decision in Salinger v. Colting, described in Chapter 9 (Fair Use) of Getting Permission, has been vacated and remanded by the Second Circuit. The Second Circuit agreed with the district court regarding its fair use analysis but vacated the judgment because the district court failed to incorporate new standards regarding preliminary injunction.
