More States Allow Transfer-on-Death Deeds

Four states have recently passed laws that make it easier and cheaper for landowners to leave property at their death. The new laws allow the use of special deeds that take effect only when the property owner dies. By using these "transfer-on-death deeds," real estate can be transferred without probate.

The states that have added transfer-on-death (TOD ) deed laws are:

• Hawaii (Senate Bill 105, effective July 1, 2011)
• Illinois (Public Act 097-0555, effective January 1, 2012)
• North Dakota (N. Dak. Cent. Code section 30.1-32.1-02 and following, effective August 1, 2011)
• Oregon (Senate Bill 815, effective January 1, 2012)
