Example Cases

Simi Valley Le Parc HOA v. ZM Corporation etc., et al, Ventura County Superior Court Case Number CIV159037 (1999-2001): In this landmark case ultimately resulting in emergency legislation, Mr. Long represented Le Parc Community Association, a newly formed non-profit mutual benefit corporation formed to govern a 264 unit condominium project following a judgment in excess of $6,000,000.00 against the previous association.

Among the issues was whether an association can be compelled to levy assessments against individual homeowners in order to satisfy a money judgment, and what common area services such as power and water may be shut off in connection with collection efforts.

Another example case is Ojai Woodlands Hoa V. Balden et al, Ventura County Superior Court (1999), a quiet title action to secure title in the association to common areas which remained in the name of the developer.

Kroeger vs. Newman: Mud slide damages case, 2008. A jury verdict of one-million plus dollars was reached.

What is your opinion regarding clients educating themselves on legal issues?

I believe it is a valuable advantage to have a client educate themselves in their legal matter, whether or not they have me represent them. In my experience, it improves our communication and often helps the client adopt reasonable expectations of his matter.

Are you willing to review documents prepared by clients?

Obviously, there is a wide range of documents and quality of preparation. Where the client is pretty close to having it right, I am more than willing to provide my experience and input, for a reasonable charge, to get the documents finalized. However, where the paper work is an utter mess and beyond salvage, I will simply recommend that the client turn it over to me to begin anew.

Are you willing to coach clients who want to represent themselves?

I have always coached clients who find themselves with a matter which, for whatever reason, is not practicable for an attorney to be involved. However, I will not coach a client who: (1) can easily afford legal representation; (2) has a matter that is too important to not involve an attorney; and (3) appears to be headed for disaster. It doesn't help me and it doesn't help the client to provide coaching in that instance.

Why did you decide to be a lawyer?

I was a plaintiff in a personal injury action and became enthralled by that experience.

What work experience and education helps you be a better lawyer?

What helps me be a better lawyer is my 22 years of practice, day in and day out, constantly growing, informing myself, with never ending unfolding experiences.

Why did you decide on your primary area of practice?

I had an interest in estate planning back in law school. My interest in real property gradually developed in my early years in practice. Small business representation developed later as my business contacts improved and increased.

What do you like best about your career?

I greatly benefited from and enjoyed the vast experience and knowledge gained from working in medium sized law firms for the first fifteen plus years. That allowed me to open my solo practice with confidence.

Tell us about your law firm:

I share a suite with two other solo practitioners, Bill Schneberg who primarily represents landlords, and Ron Landers who, like me, is a general practitioner, but focused on family law and criminal defense.

We share some staff and have a common area that includes the secretary space, conference room and break room. Most of our staff is relatively new. My previous long-term secretary went off to law school! The atmosphere in the office is excellent, and everyone appears to truly enjoy what they are doing and the time that they spend in the office.

What are your strengths and style?

I can quickly assess a new matter and predict with accuracy exactly how it will be resolved. I make sure even unwelcome news is made crystal clear to the client.

I complete legal matters more efficiently than most attorneys. My clients are made comfortable in the knowledge that their matter is in capable hands and will be concluded in a timely and cost-efficient manner.

My style is jocular, maybe a little too much of the time, but focused, even intense, when the need arises.

Personal Interests:

My interests are family, friends, music, travel, bicycling, camping, basketball, tennis, golf, reading, dining and social gatherings. At least those are what come immediately to mind.

Fixed-Price Services and Fees

I will set up a single individual corporation or LLC for $1,000.00 plus costs, a multi-party LLC or Corporation for $1,500.00 plus costs. I also negotiate fixed prices for estate planning projects such as simple wills or a relatively straight forward revocable trust with related pour-over wills, power of attorney and Advance Health care Directive forms. Prices for these range anywhere from $350.00 to $2,500.00. The more assets there are to be transferred, the higher the attorney cost. Other fixed price services involve repetitive form work, such as homeowner association pre-lien notices ($125) and liens ($250).

Hourly Rates

Attorney is $250, legal assistant drafting of lengthy projects at $25.

Free Initial Consultation?

No free initial consultation but I will match the county lawyer referral service charge of $35 for the first half hour.

Typical Retainer

$1,000-50,000, depending on such things as: the complexity of a matter, whether or not there will be a general appearance in court, the likelihood of a lengthy trial, etc.
