In the last five years, I've conducted a number of classes for attorneys, legal professionals and business people in the areas of intellectual property and internet resources. My personal continuing legal education is focused on new developments in intellectual property law.

Mark Leonard and I started Davis & Leonard LLP in January 2003 with the goal of providing high-value, first-rate representation in the areas of intellectual property and e-commerce to individuals and businesses of all kinds, throughout California, the United States, and select foreign countries with a focus on individuals and small businesses who needed excellent legal services at very competitive rates. Mark Leonard and I started Davis & Leonard LLP in January 2003 with the goal of providing first-rate representation in the areas of intellectual property and e-commerce to individuals and businesses of all kinds in the greater Sacramento area, with a focus on individuals and small businesses who needed excellent legal services. Since then, our practice has remained true to our original focus, and we continue to serve a broad range of clients in these areas.

Our practice areas include: trademark and copyright registration and licensing; trademark application and registration matters before the U.S. Patent and Trademark Office and Trademark Trial and Appeal Board; e-commerce transactions and disputes (e.g., web site terms and conditions, privacy policies, and "cyber squatting"); intellectual property litigation; and art law. Among our many clients are high technology businesses, visual artists and musicians, entrepreneurs, agri-businesses, international film production companies, retail food stores, software engineers and developers, internet service providers, inventors, graphic designers, physicians and medical groups, business consultants, flea markets and many others.

Activities and Awards

I serve on the Board of Directors of California Lawyers for the Arts and conduct workshops on contract law for artists. My law partner has held copyright law workshops for artists and commercial graphic designers.

What is your opinion regarding clients educating themselves on legal issues?

We encourage clients to familiarize themselves with the legal issues involved in any transaction or dispute in which the client is involved. A client who is educated on legal issues can make more informed decisions and helps us to provide more efficient, effective representation.

Are you willing to review documents prepared by clients?

I am always willing to review documents that clients have prepared.

Are you willing to coach clients who want to represent themselves?

At the client's request, I will provide assistance and advice to clients who want to represent themselves, and I will advise them on the risks and benefits of doing so.

Why did you decide to be a lawyer?

I chose to be a lawyer, because I believed that being a lawyer would be personally and intellectually rewarding and would give me an opportunity to have a positive impact in the world.

What work experience and education helps you be a better lawyer?

By far, the greatest experience is actually working with clients on a daily basis and trying to find the best way possible to help them meet their needs without undue time, headache or expense.

Why did you decide on your primary area of practice?

The areas of intellectual property and electronic commerce are quickly changing and intellectually fascinating, and I knew they would always be interesting.

What do you like best about your career?

As an attorney in this area I am always learning something new, either from a new issue or from my clients.

Tell us about your law firm:

My partner Mark Leonard works in the same area, with a particular emphasis on trademark registration practice. Our legal assistant Joy Morgan has extensive experience working for attorneys in a variety of capacities.

What are your strengths and style?

Strength -- ability to communicate in a straightforward and respectful manner with my clients about their issues and problems.
Expertise -- Both my partner and I have an unusual level of expertise and experience in our fields of practice in the greater Sacramento area.

Fixed-Price Services and Fees

We do not have standard fixed price rates for our services. Depending on the subject matter of the representations, we may negotiate fixed prices for services with our clients.

Hourly Rates

$260 per hour; my partner's rate is $190 per hour. Which of us performs the majority of work on a client's matter, depends on our respective work loads and the particular subject matter of the representation.

Free Initial Consultation?

Depends on the complexity of the matter and length of the consultation. I will usually offer a brief initial consultation at a reduced charge.

Typical Retainer

It depends entirely on the matter. For a simple transactional matter, such as drafting a standard contract or preparing a trademark application, I may request payment for no more than two hours of my time. For representation in litigation, I will try to estimate the initial litigation expenses and ask the client to cover them.

Nolo's Licensing Check

Attorneys have passed a licensing check. Nolo has confirmed that every member attorney has a valid license and is in good standing with the applicable bar associations upon joining the directory.

Directory lawyers are required to notify Nolo immediately if they become the subject of any disciplinary action by any bar association.
