The Fletcher Law Firm PLLC helps individuals, businesses, academic and research institutions, and government agencies create and protect their intellectual property, both in the United States and in other countries. We also work with international law firms to help their clients obtain intellectual property rights in the United States.
We are a fixed-fee, value-oriented law firm whose strength is intellectual property law, in particular patents. We also help clients obtain and protect trademarks and copyrights.
We give clients of all sizes the highest caliber work product, crafted in an imaginative yet relevant way, and delivered in a responsive and accountable fashion. We strive to build and maintain long term relationships with our clients. This policy is, we believe, beneficial to our clients as it ensures our clients have advice and assistance from a trusted advisor who knows and understands their business and goals.
I founded my firm in 2009 to create a results-driven, non-billable-hour fee option law firm to change the way intellectual property legal services are provided to clients. Most law firms provide legal services the same way they did for most of the last century. Those firms focus on profits, not clients. Their practice model relies on large numbers of people billing large numbers of hours, often without regard for the value of the work to the customer. The billable hour system used by most law firms fails to incentivize creativity and efficiency - values that today's legal service consumers are craving. It also creates an inherent conflict with clients, as lawyers are economically inclined to bill more hours, not less.
Before starting The Fletcher Law Firm PLLC, I was a patent agent and associate in the intellectual property practices of two national general practice law firms. Some examples of the types of things I did there include: drafted and prosecuted U.S. and international patent applications, revised and prosecuted foreign-origin U.S. patent applications, drafted amendments, responded to office actions, conducted interviews with examiners, prepared pre-appeal and appeal briefs, conducted clearance and patentability assessments, and drafted invalidity and non-infringement opinions. I also handled discovery activities, due diligence research and pretrial motions for the litigation, International Trade Commission and mergers and acquisitions practices.
Prior to practicing law, I served as a nuclear-trained United States Navy submarine officer for more than 20 years. There, I gained extensive experience in the practical application of electrical, mechanical, nuclear, chemical, ocean and systems engineering, and materials science. I also was responsible for the installation, testing, operation and maintenance of electrical, electronic and mechanical systems involving sonar, weapons targeting, weapons control, torpedoes and missiles aboard nuclear submarines. From my shore duty assignments, I gained in-depth technical experience in the areas of ballistic missile systems, nuclear command, control and communications systems and biological and chemical warfare systems.
I think it is great when clients want to learn about the legal issues associated with their matters and I stand ready to help my clients in that regard. One reason I was happy to be listed here in Nolo's lawyer directory is because I regularly encourage my clients to read Nolo's books on IP and business law so the client will be well-informed regarding the work I am doing. This typically results in a more appreciative and helpful client. I find that the clients who are more involved in educating themselves about the legal issues generally get better results. I also help to educate clients and other interested people on intellectual property law topics at my firm's website and on my blog.
I am very willing to review documents prepared by clients. For example, the process for many patent applications starts with a description of the invention prepared by the inventor. In such cases, I work with the client to combine the inventor's knowledge of the invention with my legal and technical expertise to get the very best results.
In very limited cases I would be willing to do so. However, I do not generally recommend it. Intellectual property law is a highly specialized field and the best results are obtained by working with a lawyer throughout the legal process.
As I began to near the end of my career in the Navy, I became aware of another frontier that fascinated me and connected with me underlying interests. First, technology and the internet drew my attention as a vast area to explore. As a student of history, I was aware that people have a habit of creating things before understanding the implications of these creations. And this cultural lag continues: technology is running ahead of our intellectual and legal systems, a fascinating and disquieting thought that suggested a dynamic frontier where I wanted to test myself. Consequently, I decided to pursue a career in intellectual property and technology law.
The foundation that makes me a better lawyer was provided by my excellent education at the Naval Academy and in the Navy's Nuclear Power Program, one of the finest multidisciplinary science and engineering training programs around. Over the course of my Navy career, I gained extensive experience in the practical application of electrical, mechanical, nuclear, chemical, ocean and systems engineering and materials science. My Navy experience taught me to be a leader, to be organized and efficient, and to think calmly under pressure. These are traits that I use every day in my law practice. The legal experience that has made me a better lawyer includes working with hundreds of individuals and businesses of all sizes on all types of intellectual property issues. Ultimately, what makes me a better lawyer is the desire and ability to achieve the best results for my clients, to never stop learning and to keep improving the quality of service I deliver to my clients.
I actually went to law school knowing I wanted to be involved with intellectual property law, especially patents. Colleagues and friends already in the legal profession told me that with my science and technology background and analytical and writing skills, a career in intellectual property law would be a great match for my abilities and interests. They were right! I love practicing intellectual property law.
Knowing that the ideas my clients have developed - and in which I have played a role in protecting - can make life better for many people. In some cases, these ideas will even save lives. Many of these ideas would not exist as commercial products without a strong intellectual property system that encourages innovation.
I am a solo practitioner, so all of my clients work directly with me. My office staff are very nice and attentive to all of my clients' immediate needs.
My strength is my focus and attention to detail. I take pride in doing the job right. I make every effort to communicate with my clients and to make sure that my clients have a good understanding of the legal processes they are involved with. I always try to make myself available to my clients to provide help and answer any questions they may have. My style is to develop a close, collaborative relationship with each client, and to provide as much information and guidance as they need. I know the process of getting started with a lawyer can involve some anxiety, so I do my best to make the process as smooth as possible. I am able to offer the right intellectual property solutions for each client, regardless of their size or past experience with intellectual property law.

In the rare situations where a fixed fee is impractical, my hourly rate is $250 per hour.

For new clients, we will generally ask for a deposit of the amount quoted in advance before starting the work.
Attorneys have passed a licensing check. Nolo has confirmed that every member attorney has a valid license and is in good standing with the applicable bar associations upon joining the directory.
Directory lawyers are required to notify Nolo immediately if they become the subject of any disciplinary action by any bar association.
