Example Cases

My most recent trial was a condemnation case against the Parish of St. Tammany in Louisiana, which sought to take land from a business client. After trial, the parish paid more than they had offered before trial plus my attorney fee to get 1/3 of the land they went to trial to take. Most of my litigation work currently is over intellectual property infringement and contract disputes. As an Assistant Attorney General (AAG), I trained now AAGs how to successfully take land for the State of Texas through administrative and civil jury trials, and also how to defend the Texas Department of Transportation in multi-million dollar highway construction and maintenance cases.

I have been an associate of Pünder, Volhard, Weber & Axster (merged with Clifford Chance in 2000) in Warsaw, Poland; of counsel for Muñoz de Toro & Muñoz de Toro in Buenos Aires, Argentina; an Administrative Law Judge and an Assistant Attorney General, Transportation Division managing the Administrative Law and Contract/Construction & Maintenance Law sections representing the Department of Transportation for the State of Texas. Since entering private practice, I have come to serve as General Counsel for numerous Internet-based and traditional companies across the U.S.

What is your opinion regarding clients educating themselves on legal issues?

Part of my job is to educate my clients regarding the law so they can see how the facts together with the law affect them and then plan the best course of action. Most of my clients have some level of understanding of the law regarding their particular issue or industry. But clients also know that part of the reason for having an experienced attorney, aside from showing your opponent that you're ready to go to trial any time, is to free them to focus on their business and avoid purely emotional reactions to legal problems.

Are you willing to review documents prepared by clients?

I often ask clients to email me lists or other writings to assist me in representing them. It saves them money. But I also advise them to have me review any contract they receive.

Are you willing to coach clients who want to represent themselves?

In some states where I practice, lawyers are prohibited from assisting pro se litigants. Courts generally do not like seeing pro se litigants because they usually cause unnecessary delays and do not know proper procedures. When I am approached by someone intending to represent themselves I generally advise them to get an attorney and explain why. However, some basic legal procedures are definitely best handled by the client themselves and I am permitted to advise them regarding those procedures.

Why did you decide to be a lawyer?

I am an independent thinker and lawyers are expected to always be learning new information and to use that information in creative ways to help their clients. The opportunity to do what I enjoy and thereby help a good client is very satisfying.

What work experience and education helps you be a better lawyer?

I began the first of six years in boarding school at the age of 12 and have studied and worked in numerous countries requiring me to learn a new language and culture. These experiences taught me to listen to new ideas and never be too proud to do what is necessary.

Why did you decide on your primary area of practice?

Technology allows me to assist clients around the world and because I am licensed in four states I choose to focus on areas of the law that do not require me to limit myself to a specific court or county or even state in order to provide exceptional legal services.

What do you like best about your career?

Almost every day something new comes up and I get to apply what I know to solving a client's important problem.

Tell us about your law firm:

I am a nontraditional solo practitioner. My clients call and write directly to me, but I have attorneys and paralegals around the world who assist me as needed. Again technology allows us and our clients to same time and money while retaining our independence.

What are your strengths and style?

Quickly picking up on new concepts and then explaining them has always come easy to me, so I have had marked success in jury trials, particularly when dealing with highly technical matters and expert witnesses. I do not overwhelm or bully; I out-think and out-work my opponents.

Personal Interests:

I enjoy cooking and traveling with my wife of many years. I serve on the board of GulfCoastDachshundRescue.org and am an avid golfer currently with a 9 handicap.

Yes, we talk with clients to make sure we can help them. Once that is confirmed, we explain exactly what we can do and what it costs. Only then would we ask for payment because the next step would be to begin giving legal advice.

Typical Retainer

It depends, but we do generally require payment in advance for anticipated work and related costs. For hourly fees, such as with litigation, we generally require enough of an advance to cover the first few steps in the process.
