Example Cases

Case History #1
Facts: Client was asleep in her car in a parking lot. The keys were in the ignition, the car was running and in park. Police officers woke her up, smelled alcohol on her breath, observed her mumble when she spoke and had difficulty with her balance. When the officers asked her to submit to roadside sobriety tests, she refused and was arrested. She refused the breath test.

Creativity: In order to prove DUI, Florida law requires the state to establish beyond a reasonable doubt that someone was driving or in actual physical control of a vehicle while under the influence of alcohol to the extent that their normal faculties are impaired. "Actual physical control" is defined as being in or on a vehicle AND having the present capability to operate the vehicle. Because she was asleep in the car, there was no way she could have had the capability to operate the vehicle.

Result: NO DUI CONVICTION

Case History #2
Facts: Client is a young man, 21 years old, 5'10", and a very slim 130 pounds. He was arrested on the Rickenbacker Causeway near Key Biscayne. The police officer had the client perform Roadside Sobriety Exercises on the causeway. Client advised us that the wind was gusting, perhaps 20-30 miles an hour and his performance on the exercises was poor as a result.

Creativity: We obtained Wind Gust Recording Charts from the United States National Climatic Data Center, in Asheville, N.C. which established the gusting wind conditions at that specific location. We established that the test conditions that night were unfair, tainted and the results of the tests could not be used as evidence.

Result: NO DUI CONVICTION

Previous Employment Summary

While attending Law School at the University of Florida, I spent the summer of 1979 working as a Legal Intern at the Dade County State Attorney's Office in Miami, Florida. My first employment as an attorney was at the Dade County State Attorney's Office upon graduation from Law School in 1981. I worked there from 1981 to 1984. My next job was at the Law Offices of Entin, Schwartz, Dion and Sclafani, P.A. in North Miami Beach, a firm devoted exclusively to criminal defense in State and Federal Courts. I worked there from 1984 to 1986 when I joined Essen and Essen, P.A., once of the first law firms in the U.S. to devote its practice to the defense of DUI/DWI cases. I worked there from 1986 to 1992, and rose to the level of Senior Trial Attorney in a firm of 17 lawyers.

What is your opinion regarding clients educating themselves on legal issues?

The internet is an incredible tool for the public. There is so much information available on thousands of legal topics that many potential clients are already armed with specific questions about their defense. This makes for a better working relationship with my clients in that they feel less helpless and more a part of their case.

Are you willing to review documents prepared by clients?

This is not really applicable in my field.

Are you willing to coach clients who want to represent themselves?

I have taken countless phone calls from people who don't hire me. That doesn't bother me at all because I know that the advice that I give them is sound and may be of good use to them if they choose to defend themselves.

Why did you decide to be a lawyer?

I watched Perry Mason as a child.

What work experience and education helps you be a better lawyer?

Being able to help otherwise good people and guide them through, and hopefully out, of the criminal justice system.

Tell us about your law firm:

I am very hands-on with my clients. They each have my cell phone number. I rarely send any other lawyer to even cover my cases in court.

What are your strengths and style?

I am very skilled in pre-trial preparation and motion practice, where 90% of cases are won. I am an excellent negotiator and command respect in the courtroom.

My fees can range from $2,500 to $5,000 for a misdemeanor; $5,000 for a first offense DUI; $7,500 to $10,000 for a felony in state court to $25,000 for a federal felony case. I can be flexible on a case by case basis and will accept payment plans. I will also consider discounts for Nolo-based referrals.
